CC Resolution 12768RESOLUTION NO. 12768 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CAMPBELL AMENDING THE COMPENSATION AND WORKING CONDITIONS FOR CLASSIFIED NOW MANAGEMENT EMPLOYEES REPRESENTED BY THE EMPLOYEE ORGANIZATION ENUMERATED BELOW WHEREAS, Title 2, Section 2.12.030(7) of the Campbell Municipal Code requires the City Manager to prepare and submit an annual salary plan to the City Council for its approval; and WHEREAS, a Memorandum of Understanding for salaries, benefits and working conditions has been approved and executed by the authorized representatives of the Campbell Police Officers Association and City Council representatives; and WHEREAS, the City Council of the City of Campbell desires to ratify and adopt the provisions included in the side letter to the Memorandum of Understanding attached. NOW, THEREFORE BE IT RESOLVED, that the City Council of the City of Campbell does hereby approve and ratify the side letter Memorandum of Understanding attached hereto and made a part hereof. PASSED AND ADOPTED this 5th day of October, 2021, by the following roll call vote: AYES: Councilmembers: Bybee, Landry, Lopez, Resnikoff, Gibbons NOES: Councilmembers: None ABSENT: Councilmembers: None APPROVED: zabeth "Li bbons, Mayor ATTEST: Dusty Christopherson, City Clerk Side Letter Agreement Between City of Campbell And Campbell Police Officers Association This Side Leiter ofAgrcement between the City of Campbell ("Ci(y") and the Campbell Police Ofticeis Association (CPOA), collectively referred to as "Parties," is entered into with respect to the following: WHEREAS. the Memorandum of Understanding (MOU) between the Parties expires on December 31.2021: Wl IEREAS. the Parties have met and conferred in good Will to extend the MOU through Decem ber 31. 2022: ` WHEREAS the Parties have agreed that the CPOA members will receive a cost of living increase; WHEREAS, the Parties have agreed to changes to CPOA members' health plan benefits; WHEREAS, the following memorializes the Parties' Agreement: I, 'Fite term ofthe NIOU is extended from December 31, 2021 to December 31, 2022; and 2. Effective the first full pay period after.lanuary 1, 2022. the base salary for all represented classifications shall be increased by three percent (3`Yo). 3. Section III(I) and (2) ofthe MOU is revised as follows: Health Insurance Benefit Program The City's maximum monthly contribution for each eligible bargaining unit member for the purchase ofinedical insurance will be equal to the minimum monthly employer contribution required under the Public Employees Medical and Hospital Care Act (PEMI-ICA). "File City's contribution will come out of the amount the City currently contributes to employees as part of the Cafeteria Plan Allowance. provided below. The cost of the City's participation in CaIPERS will not require the City to expend additional funds toward liealth insurance beyond what is already provided through the Cafeteria Plan Allowance. Any cost increase to the mininnun monthly employer contribution required under PEMCI IA will be borne by employees. 2. Cafeteria Plan Allowance CA0251027OR 1303.0 Bargaining unit members electing medical coverage in the City's plans will receive a health Ilex allowance and shall purchase such coverage through the City's Cafeteria Plan. Effective January I, 2022, the monthly Calcleria Plan Allowance will be based on selected level of coverage, as follows: Employee Only Coverage: $879 Employee Pitts One Coverage: 51,757 Employee Plus family: $2,285 Employees who elect a medical insurance plan with a lower monthly premium than the amount of the City's medical contribution may apply their unused contribution amount toward other benefit options that are available under the Cafeteria Plan, such as flexible spending accounts for out-of-pocket medical expenses and dependent care, accident insuranec, cancer insurance, heart and stroke insurance, long term care insurance, and lile insurance benefits. Employees who do not spend all their Cafeteria Plan Allowance on Cafeteria Plan benefits will not receive any cash benefit. Employees who elect Cafeteria Plan benefit options that exceed tile City's monthly C'alcteria Plan Allowance will be responsible for paying the overage through salary redireetions. 3. Conditional Opt -Out Employees who at initial enrollment or during the annual open enrollment period, complete an affidavit and provide proof'ofother minimum essential coverage for themselves and their qualified dependents (tax 11,1mily) that is not qualified health plan coverage under an exchange/marketplacc or an individual plan, will be allowed to waive medical coverage for themselves and their qualified dependents (lax family). The monthly conditional opt -out incentive is: 5750. The conditional opt -out incentive shall be paid in cash (taxable income) to the employee. The employee must notify the City within 30 days of the loss of other minimum essential coverage. 'file conditional opt-oul payment shall no longer be payable, if the employee and family members cease to be enrolled in other minimum essential coverage. 4. SubsectionsQ)—(8)of SectionllloftileMOU,willberespectivelyrenumbered(4)—(9). 5. Address overtime in the MOU to provide that the City will pay overtime to unit members in accordance with the minimum standards of the Pair Labor Standards Act (PI -SA). G. This side letter is subject to Association ratification and subsequent Council approval.
