A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CAMPBELL
APPROVING THE PLANS AND SPECIFICATIONS, AUTHORIZING TO ADVERTISE
FOR BIDS AND AWARD OF CONTRACT, AND OTHER ASSOCIATED ACTIONS
FOR THE HARRIET AVENUE SIDEWALK IMPROVEMENTS PROJECT 20-GG
WHEREAS, on July 17, 2018, Council adopted Resolution 12339 authorizing Public
Works Director to submit a Vehicle Emissions Reductions Based at Schools (VERBS)
Program grant application for the Harriet Avenue Sidewalk Improvements Project
(Project); and
WHEREAS, on March 3, 2020, Council adopted Resolution 12562 assuring the Santa
Clara Valley Transportation Authority (VTA) and Metropolitan Transportation Commission
(MTC) that the City of Campbell will complete Harriet Avenue Sidewalk Improvements
Project under the VTA's Vehicle Emissions Reduction Based at Schools (VERBS)
Program; and
WHEREAS, the Project will provide missing pedestrian facilities (infill) on the west side
of Harriet Avenue between Westmont Avenue and Van Dusen Lane with bicycle
accessibility provided for both directions of travel; and
WHEREAS, the Project carries a heavy burden of utility relocation to allow for sidewalk,
curb, gutter and associated pavement improvements; and
WHEREAS, five (5) existing trees had to be removed due to conflicts with overhead
utilities and the proposed street and sidewalk improvements; and
WHEREAS, the Project will plant thirteen (13) new street trees mitigating the removed
trees; and
WHEREAS, public outreach within the project limits has been conducted; and
WHEREAS, the public will be kept abreast of the construction schedule through notices
from the contractor before and during construction; and
WHEREAS, staff completed the final design and has prepared the plans, specifications,
and the final engineer's cost estimate for the construction contract in the amount of
$1,100,000 including a 10% contingency; and
WHEREAS, an anticipated schedule has been established in conformance with the grant
timeline; and
WHEREAS, the updated project source and use of funds total is $1,460,000, which
exceeds the original project budget by $105,000, and
WHEREAS, Transportation Development Act (TDA) funds from Bike/Ped Traffic Safety
improvement projects 21-QQ and 22-DD are available to support the Project; and
WHEREAS, funding from the Miscellaneous Storm Drainage Improvement Project 19-HH
is available to supplement the cost for storm drain related work to the Project; and
WHEREAS, a revenue of $6,038 is expected from reimbursement from various utility
companies for adjusting their facilities in the roadway.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Campbell
hereby approves the plans and specifications for the Harriet Avenue Sidewalk
Improvements Project 20-GG; authorizes the Public Works Director to advertise for bids
and award the project; authorizes City Manager to execute a construction contract with
the lowest responsive and responsible bidder in an amount not to exceed $1,000,000 and
encumber a 10% construction contingency for a total construction contract amount of
$1,100,000; authorizes the Public Works Director to reject bids and rebid the project,
should bids received have unamenable irregularities; authorizes the City Engineer to
negotiate and execute contract change orders up to and within the allocated construction
contingency; and authorize the Finance Director to perform budget adjustments.
