[01111ii FW.117 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CAMPBELL REPORT OF BID RESULTS, TO AWARD CONTRACT AS -IS TO LOWEST BIDDER, AND OTHER ASSOCIATED ACTIONS FOR THE CAMPBELL PARK IMPROVEMENT PROJECT 17-DD WHEREAS, on July 20, 2021, the City Council adopted Resolution #12741 approving the plans and specifications; authorizing the Public Works Director to advertise for bids and award the Campbell Park Improvement Project 17-DD (Project); and WHEREAS, the Project is intended to reconstruct the existing playground to increase play value with new play equipment, replace the current restroom to improve user capacity, and renovate the playground to current Americans with Disabilities Act (ADA) standards; and WHEREAS, On August 25, 2021, a total of three (3) bid proposals were received with lowest responsible and responsive bid proposal in the amount of $ $611,000 or 37% above the final engineer's cost estimate of $1,661,000; and WHEREAS, post -bid conversations with the bidders and other industry experts noted sharp increases in cost soon after the bids for the Project was advertised; and WHEREAS, four alternatives for proceeding with construction were evaluated and these alternatives have varying impact to the project schedule, budget, and project goals; and WHEREAS, the alternatives considered included: Alternative 1) Rebid with Minor Scope Modifications; Alternative 2) Award Contract As -Is to Lowest Bid; Alternative 3) Reject All Bids and Rebid Project; Alternative 4) Reduce Scope to Fit Current Budget; and WHEREAS, staff recommended Alternative 1 which by including the modifications does not impact the intent of the Project; and WHEREAS, at the November 16, 2021 City Council Meeting, the Council directed staff to award the project to the lowest bidder from the August 25, 2021 bid opening (Alternative 2). WHEREAS, a budget adjustment of $672,100 from the Parkland Dedication Fee is required to award the Project under Alternative 2; and WHEREAS, the FY 2022 Adopted CIP Budget indicates a Parkland Dedication Fee fund balance of over $2 million; and WHEREAS, the City recently received $420,000 in payment of Parkland Dedication Fees from the Cresleigh Homes development on 600 E. Campbell Avenue; and NOW, THEREFORE, BE IT RESOLVED that the City Council adopt the attached resolution for Campbell Park Improvement Project 17-DD to award contract as -is to lowest bidder; and authorize the following: the City Manager to execute a construction contract to the lowest responsive and responsible bidder in an amount not to exceed $2,272,000 plus encumber a 10% construction contingency, the City Engineer to negotiate and execute contract change orders up to and within the allocated construction contingency, and the Finance Director to perform a budget adjustment.
