CC Resolution 12800 - Adopting New Application Fees for SB9RESOLUTION NO. 12800 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CAMPBELL ADOPTING NEW APPLICATION FEES FOR SENATE BILL 9 (SB-9) APPLICATIONS IN THE CITY'S SCHEDULE OF FEES AND CHARGES WHEREAS, on December 7, 2021, the City Council adopted Interim Ordinance No. 2277 to approve urgency objective zoning standards, objective subdivision standards, and objective residential design standards as to allow for the orderly implementation of Senate Bill No. 9 (SB-9); and WHEREAS, Ordinance No. 2277 establishes a permitting process for the proposed housing developments and urban lot splits as authorized by SB-9; and WHEREAS, SB-9 did not provide a local reimbursement for implementation pursuant to Section 6 of Article XIII B of the California Constitution because a local agency has the authority to levy service charges, fees, or assessments sufficient to pay for the program or level of service mandated by the law; and WHEREAS, the proposed fees are commensurate with the amount of staff time anticipated to review SB-9 applications; and WHEREAS, it is in the public interest to balance the City's goal of cost recovery with the property owners' right to develop their property as permitted by SB-9. NOW, THEREFORE, BE IT RESOLVED that the City Council adopts the following SB-9 applications, to be included in the Schedule of Fees and Charges: SB-9 Zoning Clearance : $1,864 With an Exception Request: $ 621 With an Urban Lot Split: $ 414 PASSED AND ADOPTED this 15t day of February, 2022 by the following roll call vote: AYES: Councilmembers: Gibbons, Lopez, Landry, Bybee, Resnikoff NOES: Councilmembers: None ABSENT: Councilmembers: None APPROVED: Paul Resnikoff, Mayor ATTEST: Dusty Christopherson, City Clerk
