CC Resolution 12797 - Actions Associated with Project 21-PP Communuity Center Track ResurfacingRESOLUTION NO. 12797 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CAMPBELL APPROVING THE ACCEPTANCE OF THE REVISED COMMUNITY DEVELOPMENT BLOCK GRANT, AUTHORIZING ADVERTISEMENT OF BIDS, AWARD OF CONTRACT, AND OTHER ASSOCIATED ACTIONS FOR THE COMMUNITY CENTER TRACK RESURFACING, PROJECT 21-PP WHEREAS, in October 2020, the City Council accepted Community Development Block Grant (CDBG) funds in the amount of $67,000 from the Santa Clara County Office of Supportive Housing (SCCOSH) for the Campbell Community Track Resurfacing (Project) and to allocate $223,000 from the Parkland Dedication Fund to fund the estimated total project cost of $290,000; and WHEREAS, subsequently, SCCOSH notified the City of additional grant funds available for the Project in Fiscal Year (FY) 2021; and WHEREAS, in May 2021, the Project was approved for CDBG funds in the amount of $365,000; and WHEREAS, the additional CDBG funds would reduce the current use of Parks Dedication Fund monies from $223,000 to $40,000, a reduction and savings of $183,000 to the City; and WHEREAS, the additional funds will allow the Project to address the sections of failed sub -base and failed surrounding curb, account for increased contractual costs related to labor and supply chain impacts, while substantially reducing the City's financial contribution to the Project; and WHEREAS, the Project specifications and Notice Inviting Bids for Project 21-PP have been completed; and NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Campbell hereby approve the acceptance of Community Development Block Grant (CDBG) funds in the amount of $365,000 from the Santa Clara County Office of Supportive Housing (SCCOSH) for the Campbell Community Center Track Surfacing (Project 21-PP) by authorizing the City Manager to execute the Grant Agreement with the County to accept the CDBG funds; approve the Project Specifications; and, authorize the Public Works Director to advertise for bids and award the project; authorize the Public Works Director to reject bids and rebid the project should bids received have unamenable irregularities; authorize the City Manager to enter into a construction contract with the lowest responsive and responsible bidder and encumber a 10% construction contingency for a total construction amount of $365,0001 authorize the City Engineer to negotiate and execute contract change orders up to and within the allocated construction contingency; and BE IT FURTHER RESOLVED, that the City Council of the City of Campbell hereby authorizes the Finance Director to perform the associated budget adjustment.
