BEING AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF CAMPBELL ADOPTING PLANS, ELEVATIONS AND DEVELOPMENT
SCHEDULE FOR THE PLANNED DEVELOPMENT ZONE ESTABLISHED
BY ORDINANCE OF THE CITY OF CAMPBELL (APPLICATION OF
MESSRS. JAMES AND FRANK MACKEY, PD 78-5).
The City Council of the City of Campbell does ordain as follows:
SECT ION ONE: That the Zon i ng Map of the City of Campbe II is hereby
changed and amended by adopting the attached "Exhibit N', entitled IIPlans
and Elevations'l, 'IExhibit BII, entitled "Development Schedule", 'IExhibit C"
entitled "Map of Said Property", and "Exhibit D", entitled "Conditions of
Approval", as per the appl ication of Messrs. James and Frank Mackey for
approval of plans, elevations, and development schedule to allow conversion
of a residential building to a restaurant on property known as 106 E. Campbell
Avenue in a Plann~d Development Zoning District. Copies of said Exhibits
are on file in the office of the Planning Department.
The appl icant is notified that he shall comply with all ap~licable Codes
or Ordinances of the City of Campbell ~lihich pertain to this development and
are not herein specified.
PASSED AND ADOPTED this 26th day of June 1978, by the following roll
call vote:

CONDITIONS OF APPROVAL
APPLICATION OF MESSRS. JAMES M. AND FRANK P. MACKEY

A.
Property to be fenced and landscaped as indicated and/or as added
in red on plans.
B.
Landscaping plan indicating type and size of plant material, and
location of hose bibs or sprinkler system to be submitted for approval
of the Planning Director prior to application for building permit.
C.
Fencing plan indicating location and design details of fencing to be
submitted for approval of Planning Director prior to application for
building permit.
D.
Landscaping and fencing shall be maintained in accordance with the
approved plan.
E.
Applicant to either (1) post a faithful performance bond in the amount
of $3,000 to insure landscaping, fencing, striping of parking areas
within three months of completion of construction, or (2) file written
agreement to complete landscaping, fencing and striping of parking areas
prior to final Building Department clearance.
F.
All mechanical equipment located on roofs to be screened as approved by
the Planning Director.
G.
Conversion to begin within one year after City Council approval of this
app 1 i ca t ion.
H.
Conversion to be completed within one year.
I .
Applicant to apply for IIlandmark statusll if and when the Landmark
Preservation Ordinance is adopted by the City Council.
J.
This Planned Development permit shall apply only to Messrs. James and/or
Frank Mackey for the operation of a IIreservation onlyll restaurant. Any
subsequent owner and/or manager shall require a new Planned Development
permit.
K.
Hours of operation shall not exceed 6 p.m. to 11:30 p.m. Hours of
operation may be amended upon Planning Commission approval.
L.
External appearance of the building shall not be changed without Planning
Commission approval or as provided in the Landmark Ordinance if ápproved.
M.
Building to be used as a low intensity restaurant.
N.
All parking and driveway areas to be developed in compliance with
Section 21.50 of the Campbell Municipal Code. All parking spaces to
be provided with appropriate concrete curbs or bumper guards.
O.
Underground utilities to be provided as required by Section 20.16.070
of the Campbell Municipal Code.
P.
Plans submitted to the Building Department for plan check shall indicate
clearly the location of all connections for underground utilities including
water, sewer, electric, telephone and television cables, etc.
Q.
Sign application to be submitted in accordance with provisions of the
sign ordinance for all signs. No sign to be installed until application
is approved and permit issued by the Building Department. (Section
21.68.070 of the Campbell Municipal Code.)
R.
Ordinance No. 782 of the Campbell Municipal Code stipulates that any
contract for the collection and disposal of refuse, garbage, wet garbage,
and rubbish produced within the limits of the city of Campbell shall be
made with Green Valley Disposal Company. This requirement applies to all
single-family dwellings, multiple apartment units, to all commercial,
business, industrial, manufacturing, and construction establishments.
S.
Trash container(s) of a size and quantity necessary to serve the development
shall be located in area(s) approved by the Fire Department. Unless other-
wise noted, enclosure(s) shall consist of a concrete floor surrounded by
a solid wall or fence and have self-closing doors of a size specified by
the Fire Department. All enclosures to be constructed at grade level.
T.
Applicant shall comply with all appropriate State and City requirements
for the handicapped.
BUILDING DEPARTMENT
u.
Complete plans shall be submitted to Building Department for conversion
from F-2 professional office to B-3 assembly building including handicap
provisions, exits, etc.
FIRE DEPARTMENT
V.
Provide a kitchen hood protection system.
w.
Provide 112A-IOBCII fire extinguishers.
The applicant is notified that he/she shall comply with all applicable
Codes or Ordinances of the City of Campbell which pertain to this development
and are not herein specified.
