CC Resolution 12860 - Downtown Campbell Parklet Program to continue temporarily expand outdoor diningRESOLUTION NO. 12860 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CAMPBELL EXTENDING THE DOWNTOWN CAMPBELL PARKLET PROGRAM TO CONTINUE TEMPORARILY EXPANDED OUTDOOR DINING AND BUSINESS OPERATIONS TO JANUARY 9, 2023 WHEREAS, the Campbell City Council proclaimed a state of emergency on March 17, 2020 in response to COVID-19 following the World Health Organization's escalation of COVID-19 to a pandemic, and following declarations of states of emergency made at the County, State, and Federal levels to slow the spread of COVID-19; and WHEREAS, as required by Government Code 8630(c) the City Council reviewed the need to continue the local emergency declaration every 60 days until conditions warrant termination. The local emergency declaration has been extended in calendar year 2020, on May 5, July 24, September 15, November 2, and December 15; in calendar year 2021 on February 2, April 6, June 1, August 3, September 21, October 19, and November 16, and in calendar year 2022, on January 18, March 29, May 17, and will consider extending the local emergency declaration on July 5; and WHEREAS, on September 1, 2020, the Campbell City Council adopted Resolution 12634 authorizing establishment of the Downtown Campbell Parklet Program allowing expansion of outdoor business and dining operations in parklets located in on -street parking stalls on East Campbell Avenue from the light rail tracks to just past Third Street consistent with State and County Health Orders, City Flexible Business Operational Guidelines and the Encroachment Permit process; and WHEREAS, in calendar year 2020, the City Council extended the temporary parklet program on December 1, and in calendar year 2021, the City Council extended the temporary parklet program on April 30, June 1, September 7, December 21, and in calendar year 2020, the City Council extended the temporary parklet program January 18, and February 15 recognizing the ongoing state of emergency; and WHEREAS, traffic lanes on East Campbell Avenue in the Downtown Area remain open to vehicle traffic and provide on -street parking stalls not converted to parklets as public parking for business customers; and WHEREAS, once established, temporary parklets may remain in place until such time as the use is no longer necessary, the City Council determines the configuration needs to be altered, or the temporary parklet program extended by this Resolution is discontinued; and WHEREAS, the City is separately considering the adoption of a semi -permanent parklet program that will require several months to be ready requiring the extension of the temporary parklet program in order to minimize disruption to program participants, and WHEREAS, the City desires to establish a transition period allowing parklet operators who do not apply for a permanent parklet permit by the application deadline to vacate their current temporary parklet by January 9, 2023; NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Campbell that the Downtown Campbell Parklet Program be extended to January 9, 2023 subject to the following: 1. Continue temporarily expanded outdoor dining and business operations beyond the width of restaurant storefronts in on -street parking stalls and City -owned parking lots while the City considers the adoption and implementation of a semi- permanent parklet program; and 2. Temporary parklet operators who apply for Parklet Permits by the application deadline and obtain approval shall be allowed to continue business operations in their temporary parklets beyond January 9, 2023, but until construction of their semi -permanent parklets begins; and 3. Otherwise, all temporary parklets shall terminate expanded outdoor dining and business operations in on -street parking stalls and City -owned parking lots by close of business on January 9, 2023, so as to schedule and remove safety barriers and potted trees; and shall restore on -street parking stalls used as temporary parklets to provide public parking; and 4. Traffic lanes on East Campbell Avenue and in the Downtown Area shall remain open to vehicle traffic.
