RESOLUTION NO. 12864
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CAMPBELL
ACCEPTING IMPROVEMENTS FOR JOHN D. MORGAN PARK (BUDD AVENUE)
IMPROVEMENT PROJECT NO. 18-PP (PROJECT), AND DIRECTING THE CITY
ENGINEER TO FILE A NOTICE OF COMPLETION
WHEREAS, construction was completed in November 2021, and a dedication event
was held on December 16, 2021 for John D. Morgan Park (Budd Avenue) Improvement
Project No. 18-PP (Project); and
WHEREAS, certain warranty issues that delayed the acceptance of the improvements
are resolved; and
WHEREAS, the final project cost is $1,915,820; and
WHEREAS, the All -Inclusive Playground Grant (AIPG) is estimated to reimburse the
City an amount of $909,450 for the completed improvements; and
WHEREAS, the remaining project balance is estimated at $143,632; and
WHEREAS, staff is recommending returning the remaining project balance to the City's
Park Dedication Funds; and
WHEREAS, in accordance with the AIPG Program Grant Agreement, all grant related
activities including disbursement of reimbursement must be completed by November
10, 2022; and
WHEREAS, the Project received the Project of the Year Award from Silicon Valley
Chapter of American Public Works Association (APWA) Project of the Year Award in the
Environmental/Parks category of projects less than $2 million.
NOW, THEREFORE, BE. IT RESOLVED that the City Council of the City of Campbell
hereby accepts the improvements constructed by Robert A. Bothman Construction for
the John D. Morgan Park (Budd Avenue) Improvement Project No. '18-PP, and directs
the City Engineer to file the Notice of Completion.
