A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CAMPBELL
AUTHORIZING THE ISSUANCE OF A SPECIAL EVENT PERMIT TO THE
CAMPBELL CHAMBER OF COMMERCE FOR THE OKTOBERFEST
WHEREAS, after due consideration of all the evidence presented the City
Council did find as follows:
1. The event sponsor, the Campbell Chamber of Commerce is a local civic,
non-profit institution;
2. The dates and hours of operation for the event shall be as follows:
Saturday, October 15th 10:00 a.m. — 6:00 p.m.
Sunday, October 16th 10:00 a.m. — 5:00 p.m.;
3. The event will be located along Campbell Avenue between Railway
Avenue and Third Street and utilizes the cross streets between Civic
Center and Orchard City Drive;
4. The event will consist of beer, wine and food booths, music, craft vendors,
a kid zone;
5. The Campbell Chamber of Commerce has presented this event annually
for the last 26 years;
6. Beer and wine will be sold from booths to adults showing acceptable proof
of age;
WHEREAS, based on the foregoing findings of fact, the City Council further finds
and concludes:
1. The Special Event will not disrupt to an unreasonable extent, the
movement of traffic or create any safety hazard as a result of such
other traffic being stopped or diverted;
2. Sufficient Police service can be provided to assure proper traffic
control, security, and the orderly conduct of the special event;
3. The streets and roads over which the Special Event will be conducted
are sufficient size and construction to safely accommodate the number
of participants and the size, height and weight of any vehicles or
equipment participating in the event;
4. The Special Event will not interfere with any other public events to be
conducted on the same day;
5. The Special Event is not likely to cause injury to persons or property or
create an unreasonable disturbance of the peace;
6. The cumulative impact of this Special Event will not create an undue
strain on public resources;
7. The Oktoberfest constitutes one event that is present annually in the
City.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of
Campbell does hereby grant a Special Event Permit to the Campbell Chamber of
Commerce to hold the Oktoberfest at the location set forth in the findings of this
Resolution and that a fee waiver of 25% may be applied to fees charged by the
city, subject to the following conditions of approval:
Conditions of Approval
1. Any purchaser who appears to be 25 years of age or younger shall be
required to furnish proper identification to prove that they are 21 years.
Sales of beer and wine will only occur with the issuance of a Sales
License from the California Department of Alcoholic Beverage Control.
Any alcoholic beverage purchased at the event will be consumed or
disposed of prior to the patron leaving the event;
2. The applicant shall be subject to the insurance requirements set forth in
Chapter 11.30 of the Campbell'Municipal Code;
3. A 25% fee waiver may be applied based on a mutually acceptable
resolution with the City and the Chamber of Commerce of the Boogie
2022 debt;
4. The event shall comply with all applicable policies and ordinances of the
City of Campbell;
