I / I ?(, c' " ,'_/1£7(.-<::','<' ¿?'¿' \..~ y¿, /' v-'r / V RESOLUTION NO. 1512 L.a~Lo¡.~ ~- ~~~ PLANNING COMMISSION CITY OF CAMPBELL, CALIFORNIA After notification and publ ic hearing as specified by law on the appl ication of Chris Hopkins on behalf of Der Wienerschnitzel, Inc. for approval of an appl ication for a use permit to allow one outdoor business (service station) tò be replaced by another outdoor business (drive-in! sit-down restaurant) and approval of plans to construct a restaurant on property known as 1380 West Campbe II Avenue in a C-I-S (Neighborhood Commercial) Zoning District, as per the application fi led in the qffice of the Planning Department on Apri I 26, 1976, and after presentation by the Planning Director, proponents, and opponents, the hearing was closed. After due consideration of all evidence presented, the Commission did find as follows: I. That the replacement of the outdoor business (service station) by another outdoor bus i ness (dri ve- i n/s it-down restaurant) will not Impede the proper development of the area. 2. That the proposed use will be compatible with existing uses in the area. 3. That the establ ishment, maintenance, and operation of the proposed use wi II not be detrimental to the health, safety, peace, morals, comfort, or general welfare of persons res i ding or work i ng in the ne i ghborhood of such use, or be detrimental or injurious to the property and improvements in the neighborhood or the general welfare of the City. Based on the above findings, the Planning Commission doEJS hereby grant the requested use permit subject to the following conditions: A. Property to be fenced and landscaped as indicated and as added in "red" on plans. B. Landscape pian indicating type of plant material, location of hose bibs or sprinkler system and type of fencing to be submitted for approval of the Planning Director at time of appl ication for bui Iding permit. C. Landscaping shall be maintained in accordance with the aþproved landscape plan. D. Faithful performance bond in the amount of $3,000 to be posted to insure landscaping, fencing and siriping of parking area within three (3) months of completion of construction, or appl icant may fi Ie written agreement to complete landscaping, fencing and striping of parking area prior to final building department clearance. E. All mechanical equipment located on roofs shall be screened as approved by the Planning Director. F. All parking and driveway areas to be developed in compl iance with Section 21.50 of the Campbell Municipal Code. All parking spaces to be provided with appropriate concrete curbs or bumper guards. G. Underground uti I ¡ties to be provided as required by Section 20.16.070 of the Campbell Municipal Code. H. Plans submitted to the bui Iding department for plan check shall indicate clearly the location of all connections for underground uti I ities including water, sewer, electric, telephone and television cables, etc. I. Sign appl ication to be submitted in accordance with the provisions of the sign ordinance for all signs. No sign to be installed until appl ¡cation is approved and permit issued by the bui Iding department. J, Ordinance No, 782 of the Campbell Municipal Code stipulates that any contract for the collection and disposal of refuse, garbage, wet garbage, and rubbish produced within the. I imits of the City of Campbell shall be made with Green Valley Disposal Company. This requirement applies to all single fami Iy dwellings, multiple apartment units, to all commercial, business, industrial, manufacturing, and contruction establ ishments. K, Trash containers of a size and quantity necessary to serve the development shall be located in areas approved by the fire department. Unless otherwise noted, enclosures shall consist of a concrete floor surrounded by a solid wall or fence and have self-closing doors of a size specified by the fire department. All enclosures to be constructed at grade level. L. Applicant shall meet all state requirements for the handicapped. BUILDING DEPARTMENT M. Flat bui It-up roof covering shall be fire retardant.' PUBLIC WORKS DEPARTMENT N. Obtain excavation permit for driveway modifications and street tree installation, FIRE DEPARTMENT O. Provide a hood fire protection system. The appl icant is notified that he shall comply with all appl icable Codes or Ordinances of the City of Campbell which pertain to this development and are not herein specified.
