A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CAMPBELL
VACATING THE LIGHT AND AIR / BUILDING LINE AND FUTURE AVENUE LINE
EASEMENTS WITHIN LOT 1 OF TRACT MAP NO. 89 (PORTIONS OF HACIENDA
AVENUE — FORMERLY ALLENDALE AVENUE, AND BURROWS ROAD), AND
DIRECTING THE CITY CLERK TO RECORD THE RESOLUTION
WHEREAS, easements for light and air, and future right-of-way widening were recorded
on May 2911, 1939 on Tract Map No. 89 (portions of Hacienda Avenue — Formerly
Allendale Avenue, and Burrows Road) in Book 3 of Maps at Page 59 of Official
Records, Santa Clara County; and
WHEREAS, the easement for Light and Air / Building Line is no longer required as it
has been superseded by the setback requirements of the City of Campbell Zoning
Code -,and
WHEREAS, the easement for the Future Avenue Line is no longer required as
Hacienda Avenue will no longer be widened to the width originally envisioned at the
time Tract Map No. 89 was approved; and
WHEREAS, it is the desire of the City of Campbell to remove these outdated
encumbrances (Light and Air / Building Line and Future Avenue Line) from the property
commonly known as 1265 Burrows Road, Campbell, California 95008; and
WHEREAS, the easement vacation is to be made pursuant to Chapter 4, Summary
Vacation, of Part 3 of Division 9 of the California Street and Highway Code.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Campbell
does hereby vacate the Light and Air / Building Line and Future Avenue Line easements
within Lot 1 of Tract No. 89 recorded in Book 3 of Maps at Page 59 of Official Records,
Santa Clara County, and directs the City Clerk to record this resolution.
