A RESOLUTION OF THE COUNCIL OF THE CITY OF CAMPBELL TO AUTHORIZE
STAFF TO MOVE FORWARD WITH THE VIRGINIA PARK IMPROVEMENTS PROJECT
(NO. 20-QQ) IN THE CURRENT FISCAL YEAR (FY23) AND APPROVE AN
AGREEMENT WITH MIRACLE PLAY SYSTEMS FOR EQUIPMENT AND
INSTALLATION SERVICES IN AN AMOUNT NOT TO EXCEED $88,120.14, BY WAY OF
THE CITY'S COOPERATIVE PURCHASING AGREEMENT WITH SOURCEWELL, AND
DISPENSE OF BIDDING REQUIREMENTS AS SPECIFIED IN CAMPBELL MUNICIPAL
CODE SECTION 3.20.030(6); AND AUTHORIZE THE FINANCE DIRECTOR TO
EXECUTE A BUDGET ADJUSTMENT IN THE AMOUNT OF $110,000
WHEREAS, for over 20 years, the children's play structure at Virginia Park has been routinely
maintained to ensure availability of its amenities to members of the Campbell community;
and
WHERAS, in 2014, the Public Works Maintenance Division performed a series of asset
reviews and condition assessments on all City parks as part of staff's development of the
`Parks and Maintenance Program Asset Management Plan' which was subsequently
completed in 2015; and
WHEREAS, Virginia Park was included in staff's assessment and categorized as a `moderate
priority' rehabilitation project based on the needs of similar -ranked parks throughout the City;
and
WHEREAS, by the end of 2021, the Virginia Park Improvements Project was one of the few
projects that had yet to begin from the collective list of park improvements identified in the
2015 Asset Management Plan; and
WHEREAS, in June 2022, the City Council approved the Virginia Park Improvements Project
as part of the City's Capital Improvement Plan (CIP) for Fiscal Years 2023 — 2027, allocating
$320,000 of Park Dedication funds in the CIP Budget for use over Fiscal Years 25 and 26
($70,000 and $250,000, respectively); and
WHEREAS, in November 2022, staff from the Public Works Department discovered
significant deterioration of the park's original wooden playground structures that presented
potential health and safety risks to the public and prompted staff's complete removal of the
impacted equipment; and
WHEREAS, with these latest developments, staff recommends advancing the Virginia Park
Improvements Project to begin this current Fiscal Year (FY 23); and
WHEREAS, staff has pursued the development of a timely improvement plan for Virginia
Park that expands accessibility of amenities that meet all current safety and ADA standards,
while enhancing the park's overall appearance; and
WHEREAS, Miracle Play Systems, due to their successful previous work history with the
City, has developed a design concept that includes equipment procurement and installation
services to improve and expand play opportunities at Virginia Park; and
WHEREAS, Miracle Play Systems would also apply a discount to equipment costs on behalf
of the City's membership in the Sourcewell Purchasing Cooperative Agreement; and
WHEREAS, the City may utilize its membership with Sourcewell in place of the standard
Request for Qualifications (RFQ) process under the provisions of the Campbell Municipal
Code Section 3.20.30(6); and
WHEREAS, staff presented the proposed plan to the Parks and Recreation Commission at
the February 1, 2023, meeting and the Commission voted to approve a recommendation in
support of staff's proposed plans and early commencement of the Virginia Park
Improvements Project; and
WHEREAS, City Council authorization is required as the Project exceeds the $50,000
threshold; and
WHEREAS, staff has estimated a budget of $110,000 for all project -related expenditures,
and
WHEREAS, funds previously allocated for the Virginia Park Project in future years will revert
to the City's Park Dedication Fund for use on other park improvement projects.
NOW, THEREFORE, BE IT RESOLVED that the Council of the City of Campbell hereby
authorizes staff's commencement of the Virginia Park Improvements Project (No. 20-QQ)
this current fiscal year (FY23) and approves an agreement with Miracle Play Systems, in an
amount not to exceed $88,120.14, to provide Equipment and Installation Services, through
the City's participation in a Cooperative Services Agreement with Soucewell (a Cooperative
Purchasing Firm), and dispenses with bidding requirements as authorized in Campbell
Municipal Code Section 3.20.030(6) for professional services intended to provide information
for staff's use during project development and routine contractual services during subsequent
project implementation.
BE IT FURTHER RESOLVED that the City Council hereby authorizes the Finance Director
to execute a budget adjustment in the amount of $110,000 for all project -related costs, with
changes to be reflected in the proposed CIP Budget scheduled for presentation to Council
in spring 2023.
