A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CAMPBELL
DETERMINING FINDINGS FOR THE SEMI -PERMANENT PARKLET GRANT
PROGRAM ARE CONSISTENT WITH SECTION 53083 (a)(6)(b) OF THE
GOVERNMENT CODE (AB 562)
WHEREAS, to continue assisting Downtown restaurants with recovery from the economic
impacts of the COVID-19 pandemic, on July 5, 2022, the City Council, adopted Ordinance
2285 adding Chapter 11.15 (Parklets in the Public Right -of -Way) to the Campbell Municipal
Code and adopted Resolution 12858 approving the adoption of a Semi -Permanent Parklet
Program Guide;
WHEREAS, to continue assisting Downtown restaurants' with recovery from the economic
impacts of the COVID-19 pandemic, on October 4, 2022, the City Council approved Ordinance
2289 approving Amendments to the Semi -Permanent Parklet Program Guide to incorporate
preferred parklet designs), an amendment to the City's Master Fee Schedule to not reduce the
Parklet Permit Application Fee from $1,500 to $500, deferring the effective date of the Parklet
Annual Compliance Verification Fee to FY 2024, removing security deposits related to parklets in
the public right-of-way, and approving associated budget adjustments for FY 2023; setting a
$400,000 allocation of American Recovery Act Funds (ARPA) funds for the Semi -Permanent
Parklet Grant Program to assist businesses with the parklet construction for up to 16 parklets with
a minimum grant of $25,000 and a maximum grant of $40,000 depending on the number of grants
approved;
WHEREAS, Nine (9) Downtown businesses are recommended to be approved for grants
up to $40,000 to assist with the construction costs of the parklets, expand dining options for
visitors and local residents, increase sales for businesses and sales tax revenues for the City
and also add to the economic stability of the Downtown.
WHEREAS the findings associated with the parklet grants or economic assistance for
businesses constitute a development subsidy consistent with Section 53083 (a)(6)(b) of the
Government Code (AB 562) of the State of California.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF CAMPBELL HEREBY RESOLVES
AS FOLLOWS:
1. The Council finds that the grants are approved under this resolution and will foster recovery
for Campbell businesses from the economic impacts of the COVID-19 pandemic, and will
enhance the vitality of the City's downtown core by facilitating the installation of semi-
permanent parklets in the downtown area, enhancing the consumer and business
experience;
2. The grants shall be made available commencing March 1, 2023 and shall terminate upon
distribution of the final reimbursement payments for installation of the semi -permanent
parklets;
3. The City Council authorizes grants to the businesses set forth in Attachment B in an amount
not to exceed $40,000 in reimbursement for actual expenses incurred for installation of semi-
permanent parklets;
4. The total grant expenditure by the City shall not exceed $400,000;
5. The projected tax revenue to the City as a result of the grants is estimated to be $50,000
annually;
6. The estimated jobs created by the grants are projected to be:
Full-time: Seven
Part-time: Seventeen
Temporary: None
7. Every grant recipient shall execute an agreement in a form satisfactory to the City Manager
and City Attorney regarding the use of such grant funds;
8. A copy of this Resolution shall be made available to the public upon request, and shall be
posted on the City's website for the duration of the grant program.
