CC Resolution 12970 - Associated Actions for the Camden Avenue Resurfacing, Project 21-SSRESOLUTION NO. 12970 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CAMPBELL APPROVING PLANS AND SPECIFICATIONS, AUTHORIZING ADVERTISEMENT OF BIDS, AWARD OF CONTRACT, NECESSARY BUDGET ADJUSTMENTS, AND OTHER ASSOCIATED ACTIONS FOR THE CAMDEN AVENUE RESURFACING, PROJECT 21-SS WHEREAS, Camden Avenue south of Winchester Boulevard is in "very poor" condition with a Pavement Condition Index (PCI) as low as 19 out of a possible 100; and WHEREAS, the City Council adopted Resolution No. 12682 creating the Camden Avenue Resurfacing Project 21-SS (Project); and WHEREAS, the Project will also construct public improvements such as sidewalks, curb and gutter, and ADA compliant driveways in areas lacking these improvements along the east side of the street; and WHEREAS, by constructing new sidewalks along two property frontages will necessitate the filing of Notice of Improvement Obligations in accordance with the City Municipal Code Section 11.24.080; and WHEREAS, the Project will plant eight (8) trees to replace the two (2) removed palm trees that were found to be in conflict with the proposed improvements; and WHEREAS, a total of $20,600 is estimated for the utility adjustment work included as additive alternates in the bid documents; and WHEREAS, the construction contract will limit the paving activities to take place during the hours of 8 p.m. to 5 a.m. to minimize impacts to businesses and residents due to the access limitations to Camden Avenue; and WHEREAS, the plans and specifications for the Camden Avenue Resurfacing Project 21-SS have been prepared; and WHEREAS, sufficient funding sources have been identified for the Camden Avenue Resurfacing Project 21-SS. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Campbell hereby approves the plans and specifications; authorizes the Public Works Director to advertise for bids and award the project; authorizes the City Manager to enter into a construction contract with the lowest responsive and responsible bidder in an amount not to exceed $1,218,500 and encumber a 10% construction contingency for a total construction contract amount of $1,340,350; authorizes the City Engineer to negotiate and execute contract change orders up to and within the allocated construction contingency; authorizes the Public Works Director to reject bids and rebid the project, should bids received have unamenable irregularities; NOW, THEREFORE, BE IT FURTHER RESOLVED that the City Council of the City of Campbell hereby authorizes the Finance Director to perform a budget adjustment for using Miscellaneous Storm Drain Improvements — FY23 to augment the Camden Avenue Resurfacing Project budget.
