A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CAMPBELL
AUTHORIZING THE ISSUANCE OF A LIVE ENTERTAIMENT PERMIT
TO BRANDON BRIGHAM FOR THE BUSINESS COMMONLY KNOWN
AS KHARTOUM, LOCATED AT 300 ORCHARD CITY DRIVE, SUITE
101, IN CAMPBELL, CALIFORNIA.
WHEREAS, after due consideration of all the evidence presented, the City
Council does find as follows:
1. The applicant is over 18 years of age;
2. The required application fee has been paid;
3. The applicant has not knowingly made any false, misleading, or fraudulent
statement of material fact on the application;
4. The proposed use would not constitute a violation of the provisions of the
Campbell Municipal Code, or other applicable law;
5. The applicant has not been convicted of a felony or crime of moral
turpitude; and
6. The proposed operation would not result in a public nuisance as defined in
the Campbell Municipal Code, or Section 370 of the California Penal
Code; and
WHEREAS, after due consideration of all the evidence presented, the City
Council does believe granting a Live Entertainment permit, with conditions, to
Brandon Brigham to allow for late night activities and live entertainment on the
property located at 300 Orchard City Drive, Suite 101, in Campbell, California,
commonly known as "Khartoum," is appropriate;
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of
Campbell hereby grants a Live Entertainment permit to Brandon Brigham to allow
for late night activities and live entertainment on the property located at 300
Orchard City Drive, Suite 101, in Campbell, California, commonly known as
"Khartoum," subject to the following conditions:
1. The hours of operation for live entertainment shall be restricted to between
9:00 p.m. and 1:00 a.m., Wednesday through Saturday.
2. The live entertainment shall be limited to musical entertainment consisting
of disc -jockey and/or karaoke performances, with no live bands.
3. The owner/operator of the subject property shall provide one bonded,
certified (guard card), uniformed, security guard for every 50 patrons in
conjunction with the live entertainment events.
4. All bartenders, and door and security staff shall obtain ABC LEADS
training within 30 days of hire.
5. Any noises, sounds and/or voices, including but not limited to amplified
sounds, loudspeakers, sounds from audio sound systems, music, and/or
public address systems, generated by the establishment shall not be
audible to a person of normal hearing capacity from any residential
property.
6. Khartoum Management and Security staff shall meet with the Campbell
Police Night Shift Patrol team on a semi-annual (every six months) basis
for a minimum of two years, beginning in October 2022.
7. The establishment shall adhere to the operational measures described in
the Memorandum submitted to the City by Khartoum on August 11, 2022
entitled, "Mitigation Efforts to Promote Public Safety." Any proposed
modifications to the operational measures shall be first discussed with the
Campbell Police Department.
