ORDINANCE NO. 1643
BEING A ORDINANCE OF THE CITY OF CAMPBELL
ADDING CHAPTER 11.30 - INSURANCE REQUIREMENTS
FOR ENCROACHMENT - TO THE CAMPBELL MUNICIPAL CODE
The City Council of the City of Campbell does ordain as follows:
SECTION ONE: That Chapter 13.02 be added to the Campbell Municipal
Code, revised to read as follows:

INSURANCE REQUIREMENTS

Insurance Certificates Required.

11.30.010 Insurance Certificates Required. Any applicant seeking a
permit from the City to conduct any activity on, above, or below any
public right-of-way, or other public place, that impedes the normal
use of such place or right-of-way shall file a certificate of
insurance with the City Finance Director in accordance with Section
11.30.020.
11.30.020 Contents of Insurance Certificate. A certificate of
insurance required under Section 11.30.010 must be in a form
acceptable to the City Finance Director, and must demonstrate that the
applicant has obtained viable insurance coverage for himself/herself
and the City of Campbell, its agents, officers, officials, and
employees, in an amount acceptable to the City Manager, for any and
all property damages or personal injuries that might arise out of the
contemplated encroachment on the public place or right-of-way. If
said encroachment will involve the serving of alcoholic beverages, the
certificate of insurance must evidence coverage for liquor liability.
11.30.030 Exceptions. Notwithstanding Sections 11.30.010 and
11.30.020, the City Council may modify or waive the provisions of this
Chapter if it finds either of the following:
(a) The likelihood of a significant claim for property damage or
personal injury arising out of the contemplated encroachment is
negligible and extremely remote; or
(b) The applicant has provided an alternative form of surety, which
affords the City with comparable coverage to that coverage
required by Sections 11.30.010 and 11.30.020.
