BEING AN ORDINANCE OF THE CITY COUNCIL OF
THE CITY OF CAMPBELL APPROVING A MODIFICATION
TO A PREVIOUSLY APPROVED PLANNED
DEVELOPMENT PERMIT, PLANS, ELEVATIONS,
DEVELOPMENT SCHEDULE, AND CONDITIONS OF
APPROVAL (ORDINANCE NO. 1560) TO ALLOW
A CHANGE IN PARKING DESIGN OF PHASE I AND
A CHANGE IN BUILDING MATERIALS ON PROPERTY
KNOWN AS 900 E. HAMILTON AVE. IN A PD
(PLANNED DEVELOPMENT/COMMERCIAL - PUBLIC,
SEMI-PUBLIC) ZONING DISTRICT. (APPLICATION OF
MR. TODD WRIGHT, ON BEHALF OF PROMETHEUS DEVELOP-
MENT CO., AND 900 E. HAMILTON AVE., A LIMITED
PARTNERSHIP , M 87-14 (PD 84-06).
The City Council of the City of Campbell does ordain as follows:
SECTION ONE: That Ordinance No. 1560 is hereby amended to allow
primarily surface parking rather than subterranean/surface parking as
previously approved, and to allow a change in building materials as
previously approved, on property known as 900 E. Hamilton Ave. by adopting
the attached Exhibit A entitled Plans and Elevations; Exhibit B entitled
Additional Conditions of Approval, including conditions which address the
rewording of Condition #7 and Condition #13 of Ordinance No. 1560; and,
Exhibit C entitled Conditions of Approval adopted by Ordinance No. 1560;
as per the application of Mr. Todd Wright, on behalf of Prometheus
Development Co., and 900 E. Hamilton Ave., a Limited Partnership for a
modification to a previously approved Planned Development Permit (PD
84-06) in a Planned Development Zoning District. Copies of said Exhibits
are on file in the Planning Department.
SECTION TWO: This Ordinance shall become effective 30 days following
its passage and adoption and shall be published once within 15 days upon
passage and adoption in the San Jose Mercury News, a newspaper of general
circulation in the City of Campbell, County of Santa Clara.

OF APPROVAL
It should be noted that all conditions indicated in Ordinance No. 1560
still apply to the project. Conditions listed below address specific
requirements identified in the most recent review of revised plans for
Phase I.
FIRE DEPARTMENT
1. Provide a Class I standpipe in each stairwell.
2. All areas of the building, including the parking garage, shall be
protected by an automatic sprinkler system.
3. Provide municipal -type fire hydrants at 300 foot intervals along
access driveways.
4. Access driveways shall be designated as fire lanes with signs
designating "no parking".
5. Provide Class III standpipes and hose cabinets in the parking garage.
6. During building construction, a temporary standpipe shall be provided
as per Sec. 3806 of Uniform Building Code.
7. Building elevators shall have Fire Department recall capability.
BUILDING DEPARTMENT
8. Consideration in design for the following:
Wood shingles on Executive Suites shall meet requirements of Section.
3202(b) of Uniform Building Code - Phase III.
Large window areas shall comply with energy efficiency standard
effective January 1, 1987, Title 20 & 24, Phases I, II, & III.
PUBLIC WORKS DEPARTMENT
9. Process and file a subdivision map prior to issuance of a building
permit.
10. Provide a copy of title report prior to issuance of a building permit.
11. Provide grading and drainage plan to City Engineer prior to issuance
of a building permit.
12. Obtain excavation permit, pay fees and post surety to construct all
public improvements prior to issuance of a building permit.

13. At the discretion of the City Council, subject to posting appropriate
security, occupancy of the Phase I building may be permitted prior to
completion of those public improvements on Hamilton Avenue which are
delayed by Southern Pacific Railroad Company, the Public Utilities
Commission or the State Department of Transportation through no
omission or fault of the developer."
14. Phase II and III of this project require the submittal of detailed
elevations, site plans, and parking analysis to the Planning
Department for approval of the Site and Architectural Review Committee
and the Planning Commission prior to issuance of building permits for
these portions of the project.
15. Landscaping plan indicating the type and size of plant materials,
location of irrigation system, protection and retention of existing
redwood trees, details of planters, hardscape, and a pedestrian
circulation plan to be submitted to the Planning Department for review
by the Parks & Recreation Commission, and for approval by the Planning
Commission prior to issuance of a building permit.
16. Applicant to submit a fencing plan for the approval of the Planning
Director prior to issuance of a building permit.
17. Applicant to provide an access easement and design details of bikeway
and loading ramp, satisfactory to the City Engineer, to address the
access and maintenance needs of the Santa Clara Valley Water District,
prior to issuance of a building permit.
18. Applicant to provide creek embankment stablization, satisfactory to
the Santa Clara Valley Water District and the Public Works Director,
to protect the creek bank adjacent to the PG&E tower, prior to
occupancy of Phase I.
19. In addition to all previous conditions of approval recommended by the
Public Works Department, construction of bicycle -pedestrian path
undercrossing of new public street on westerly side of Los Gatos
Creek. This path to connect to proposed parking on southerly side of
street and to walkway over Los Gatos Creek on northerly side of
street, all as directed by City Engineer.
PLANNING COMMISSION
20. That the Council amend Ordinance No. 1560 (PD 84-06) - Condition 7 -
to read as follows:
"7. Applicant shall satisfy requirements of all other agencies
having jurisdiction over this proposal, such as (but not
limited to) PG&E, Santa Clara Valley Water District, State
Department of Fish and Game, Sanitation District No. 4, and
Santa Clara County Parks (Los Gatos Creek Streamside
Committee), prior to issuance of a building permit."

The applicant is notified as part of this application that he/she is required
to meet the following conditions in accordance with the Ordinances of the City
of Campbell and the Laws of the State of California.
THE FOLLOWING CONDITIONS MUST BE SATISFIED PRIOR TO ISSUANCE OF A BUILDING
PERMIT:
1. Revised elevations and site plan indicating detailed site layout and
dimensions, dimensions of all parking areas, and detailed construction phasing
plan to be submitted to the Planning Department and approved by the Site and
Architectural Review Committee and the Planning Commission prior to application
for a building permit.
2. Relocation assistance plan to be approved by the City Council.
3. Landscaping plan indicating type and size of plant material, and location of
irrigation system and fencing to be submitted to the Planning Department and
approved by the Site and Architectural Review Committee and Planning Commission
prior to issuance of a building permit.
4. Applicant to either (1) post a faithful performance bond in the amount of
$25,000.00 to insure landscaping, fencing, and striping of parking areas within
3 months of completion of construction; or (2) file written agreement to
complete landscaping, fencing, and striping of parking areas. Bond or
agreement to be filed with the Planning Department prior to application for a
building permit.
5. All mechanical equipment on roofs and all utility meters to be screened as
approved by the Planning Director.
6. Plans submitted to the Building Department for plan check shall indicate
clearly the location of all connections for underground utilities including
water, sewer, electric, telephone and television cables, etc.

Public Works Department
9. Develop a site plan incorporating those parameters identified in the EIR and
design study, including providing 180' minimum of vehicular storage from
Hamilton Avenue south to the new off -ramp signal. Site plan to include roadway
geometry and access points as directed by the City Engineer.
10. After developing a site plan and roadway alignment acceptable to the City
Engineer, obtain Cal -Trans, SPRR and PUC approval.
THE FOLLOWING CONDITIONS MUST BE SATISFIED PRIOR TO PHASE ONE BUILDING
OCCUPANCY:
11. Property to be fenced and landscaped as indicated and/or added in red on
the plans. Landscaping and fencing shall be maintained in accordance with the
approved plans.
12. Applicant to submit a plan to the Planning Department, prior to
installation of PG&E utility (transformer) boxes, indicating the location of
the boxes and screening (if boxes are above ground) for approval of the
Planning Director.
13. 13. Building occupancy will not be allowed until public improvements are

14. All parking and driveway areas to be developed in compliance with Chapter
21.50 of the Campbell Municipal Code. All parking spaces to be provided with
appropriate concrete curbs or bumper guards.
15. Underground utilities to be provided as required by Section 20.16.070 of
the Campbell Municipal Code.
16. Sign application to be submitted in accordance with provisions of the Sign
Ordinance for all signs. No sign to be installed until application is approved
and permit issued by Planning and Building Departments (Section 21.68.030 of
the Campbell Municipal Code).
17. Ordinance No. 782 of the Campbell Municipal Code stipulates that any
contract for the collection and disposal of refuse, garbage, wet garbage and
rubbish produced within the limits of the City of Campbell shall be made with
Green Valley Disposal Company. This requirement applies to all single-family
dwellings, multiple apartment units, to all commercial, business, industrial,
manufacturing, and construction establishments.
18. Trash container(s) of a size and quantity necessary to serve the
development shall be located in area(s) approved by the Fire Department.
Unless otherwise noted, enclosure(s) shall consist of a concrete floor
surrounded by a solid wall or fence and have self -closing doors of a size
specified by the Fire Department. All enclosures to be constructed at grade
level and have a level area adjacent to the trash enclosure area to service
these containers.

19. Applicant shall comply with all appropriate State and City requirements for
the handicapped.
20. Noise levels for the interior of residential units shall comply with
minimum State (Title 25) and local standards as indicated in the Noise Element
of the Campbell General Plan.
21. The applicant is hereby notified that the property is to be maintained free
of any combustible trash, debris and weeds, until the time that actual
construction commences. All existing structures shall be secured by having
windows boarded up and doors sealed shut, or be demolished or removed from the
property. Sect. 11.201 & 11.414, 1979 Ed. Uniform Fire Code.
Fire Department
22.(A) All driveways within the complex shall have a minimum width of 20' and a
minimum vertical clearance of 13'6".
(B) An emergency access driveway for Fire Department vehicles shall be
provided on the northwest side of the hotel.
(C) Entrance ramps to the underground parking structures shall have a
minimum turning radius of 40'.
23.(A) Municipal fire hydrants shall be provided at 300 foot intervals along
access roadways throughout the complex.
(B) The hotel, office buildings, and below ground parking structures shall
be provided with an automatic sprinkler system throughout. System shall
be monitored on a 24-hour basis.
(C) All subterranean areas, including walkways, shall be protected by the
automatic sprinkler system.
Building Department
24. Office buildings should be Type II F.R. Buildings to meet requirements of
Sec. 504(c) UBC.
25. All openings from parking garages shall be 20' from property lines. Sec.
709 UBC.
26. Public Works Department:
CONSTRUCT THE FOLLOWING PUBLIC IMPROVEMENTS:
(A) Construct a two-way public street with pedestrian access traversing
the development from Campisi Way across a new bridge structure over Los
Gatos Creek, connecting to a new Highway 17 off -ramp signal and to
Hamilton Avenue.
(B) Reconstruct the northbound Highway 17 off -ramp as required by the
City Engineer and Cal -Trans.
(C) Construct a traffic signal at the intersection of Campisi Way and the
new street.

(D) Construct a traffic signal at the intersection of the new street and
the Highway 17 northbound off -ramp.
(E) Construct a traffic signal at the intersection of the new street and
Hamilton Avenue.
(F) Provide interconnection of the above new signals and the existing
signals at Hamilton and April, Hamilton and Bascom, Hamilton and
Salmar/Highway 17, Hamilton and Central, and Hamilton and Winchester.
Provide all necessary hardware and software for signal system
interconnect as required by the City Engineer.
(G) Construct a free right -turn lane and signal modification as required at
the southeast corner of Hamilton and Winchester.
(H) Construct an additional westbound lane on Hamilton Avenue across
Highway 17 through Salmar Avenue intersection.
(I) Construct street improvements on the southeast corner of Hamilton and
Leigh to provide an additional northbound lane on Leigh and an
additional eastbound lane on Hamilton Avenue.
(J) Modify traffic signal installation at the intersection of Bascom Avenue
and Campisi Way and widen as necessary to provide two northbound
left -turn lanes while maintaining three through lanes at intersection.
(K) Install median islands on Hamilton Avenue between Los Gatos Creek and
Highway 17.
(L) Construct a bus pull-out lane and shelter on Hamilton Avenue frontage
of development.
(M) Provide pedestrian -bicycle pathway along westerly bank of Los Gatos
Creek and across new bridge to easterly creek bank.
