ORDINANCE NO. 1773
BEING AN ORDINANCE OF THE CITY COUNCIL OF
THE CITY OF CAMPBELL APPROVING A PLANNED
DEVELOPMENT PERMIT, PLANS, ELEVATIONS,
DEVELOPMENT SCHEDULE, AND CONDITIONS OF
APPROVAL TO ALLOW ESTABLISHMENT OF A HOSPITAL
FOR IN -PATIENT AND OUT -PATIENT CARE ON PROPERTY KNOWN AS
42 WEST CAMPBELL AVENUE IN A PD (PLANNED DEVELOPMENT/
PROFESSIONAL OFFICE) ZONING DISTRICT. APPLICATION OF
MR. BRUCE HODGIN, PD 89-18.
The City Council of the City of Campbell does ordain as follows:
SECTION ONE: That the Zoning Map of the City of Campbell is hereby changed
and amended on property known as 42 West Campbell Avenue, by adopting the
attached Exhibit A entitled Plans and Elevations; Exhibit B entitled
Development Schedule; Exhibit C entitled Map of Said Property; and Exhibit D
entitled Conditions of Approval, as per the application of Mr. Bruce Hodgin for
plans, elevations, and development schedule to allow the establishment of a
Hospital in a Planned Development Zoning District. Copies of said Exhibits are
on file in the Planning Department.
SECTION TWO: This Ordinance shall become effective 30 days following its
passage and adoption and shall be published once within 15 days upon passage
and adoption in the San Jose Mercury News, a news paper of general circulation
in the City of Campbell, County of Santa Clara.
PASSED AND ADOPTED this 2nd day of January, 1990 by the following roll
call vote:

CONDITIONS OF APPROVAL

APPLICANT: BRUCE HODGIN
The applicant is hereby notified, as part of this application, that he/she is
required to meet the following conditions in accordance with the Ordinances of
the City of Campbell and the Laws of the State of California. Additionally,
the applicant is hereby notified that he/she is required to comply with all
applicable Codes or Ordinances of the City of Campbell and the State of
California which pertain to this development and are not herein specified.
1. That the Planned Development Permit shall expire in five (5) years from
date of occupancy. Said permit may be terminated prior to five years if
there are findings of hazards to the health, safety, and welfare of the
community, or unusual police activity at the site.
2. Provide an analysis of how square footage is increased per 506 U.B.C.
3. Shoe how four hour separation will be provided between B-1 and I-2 per
table 5B U.B.C.
4. Show how maximum height of stories can be complied with per table 5A
U.B.C.
5. If this is a skilled nursing facility, it may need submittal to the State
for permits and inspections.

Fire Department
6. The existing building construction type will not meet minimum requirements
of an I-2 Occupancy. U.B.C. 502, Table 5B; and, U.B.C. 503, Table 5D.
7. Operational Limitations:
A. The use shall be operated by a major hospital located within a ten
mile radius of this site; and,
B. The use shall be staffed at all times by at least two licensed medical
professionals (e.g., doctors, registered nurses, licensed vocational
nurses) with experience in dealing with chemically dependent patients.
C. Total staff on the site at any time shall not exceed 30 or be less
than 2.
D. The total number of "in -patients" on the site should not exceed 30.
All patients shall be at least 18 years of age.
E. The facility shall not be used for treatment of persons for the
purpose of fulfilling a condition of criminal probation or other
conditions imposed, as the result of a criminal conviction.
