CC Ordinance 1781ORDINANCE NO. 1781 BEING AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CAMPBELL, APPROVING A PLANNED DEVELOPMENT PERMIT, PLANS, ELEVATIONS, DEVELOPMENT SCHEDULE AND CONDITIONS OF APPROVAL FOR CONSTRUCTION OF 68 CONDOMINIUMS, ON PROPERTY KNOWN AS 110 MICHAEL DRIVE, APPLICATION OF MR. BURCH BOONE, ON BEHALF OF LINCOLN BASCOM OFFICE CENTER, LTD., IN A C-PD (CONDOMINIUM -PLANNED DEVELOPMENT) ZONING DISTRICT, PD 89-20. The City Council of the City of Campbell does ordain as follows: SECTION ONE: That the Zoning Map of the City of Campbell is hereby changed and amended on property known as 110 Michael Drive - APN: 412-10-46, by adopting the attached Exhibit A, entitled Plans and Elevations; Exhibit B, entitled Development Schedule; Exhibit C, entitled Map of Said Property; and Exhibit D, entitled Conditions of Approval, as per the application of Mr. Burch Boone, on behalf of Lincoln Bascom Office Center, Ltd., for plans, elevations, and development schedule to allow the construction of 68 Condominiums, in a Condominium -Planned Development Zoning District. Copies of Said Exhibits are on file in the Planning Department. SECTION TWO: This Ordinance shall become effective 30 (thirty) days following its passage and adoption and shall be published once within 15 (fifteen) days upon passage and adoption in the San Jose Mercury News, a newspaper of general circulation in the City of Campbell, County of Santa Clara, State of California. Additionally, the applicant is hereby notified that he/she is required to comply with all applicable Codes or Ordinances of the City of Campbell and the State of California which pertain to this development and are not herein specified. 1. Utilities: Underground utilities to be provided as required by Section 20.36.150 of the Campbell Municipal Code. 11. Utilities: Plans submitted to the Building Department for plan check shall indicate clearly the location of all connections for underground utilities including water, sewer, electric, telephone and television cables. 12. Signing: Sign application to be submitted in accordance with provisions of the Sign Ordinance for all signs. No sign to be installed until application is approved and permit issued by Planning and Building Departments (Section 21.53 of the Campbell Municipal Code). 13. Garbage Collection: Ordinance No. 782 of the Campbell Municipal Code stipulates that any contract for the collection and disposal of refuse, garbage, wet garbage and rubbish produced within the limits of the City of Campbell shall be made with Green Valley Disposal Company. This requirement applies to all single-family dwellings, multiple apartment units, to all commercial, business, industrial, manufacturing, and construction establishments. 14. Trash Containers/Enclosures: Trash container(s) of a size and quantity necessary to serve the development shall be located in area(s) approved by the Fire Department. Unless otherwise noted, enclosure(s) shall consist of a concrete floor surrounded by a solid wall or fence and have self -closing doors of a size specified by the Fire Department. All enclosures to be constructed at grade level and have a level area adjacent to the trash enclosure area to service these containers. 15. Handicapped Requirements: Applicant shall comply with all appropriate State and City requirements for the handicapped. 16. Noise Levels: Noise levels for the interior of residential units shall comply with minimum State (Title 25) and local standards as indicated in the Noise Element of the Campbell General Plan. 17. Park Dedication Fee: Applicant is hereby notified that he will be required to pay a Park Dedication In -Lieu Fee which will be assessed at the time the subdivision map is submitted. BUILDING DIVISION 18. Retaining Walls: Retaining walls at property lines are limited to a height of 15 inches if constructed of wood. 19. R-1, one hour construction throughout 1202(b) UBC. 20. Requires the submittal of a complete allowable area study UBC 505. 23. If the three hour horizontal separation permitted in UBC, Section 7O2(a) is used to increase the area or height of the building, the following shall apply: a. Compliance with UBC, Section 7O2(a) 1, 2, 3 and 4. b. The proposed first story parking level is restricted to the storage of passenger vehicles, and may contain laundry room and mechanical rooms incidental to the operation of the building, and shall not include residential units. CAC Title 19, Section 3.05 requires minimum 20 feet wide access roads from EVERY building to a public street. Roads shall be all-weather and hard -surfaces; existing turf -block not allowed, UFC 1O.207(a). 26. CAC Title 24, Section 2-1216 requires a fire alarm system unless all provisions of said section has been complied with and all R-1 Buildings are no more than two stories in height. 27. All portions of the parking levels shall be located within 200 feet travel distance to the nearest exterior exit door, enclosed stairways or other exit ways., UBC, Section 33O3(c). 28. On -site fire hydrants are required under UFC, Section 1O.3O1(c). 29. Provide key lock box keyed to the Campbell Fire Department Know Box system. UFC, Section 10.209. 30. The fire sprinkler system shall be fully supervised by an approved central alarm station. UFC, Section 10.309. PUBLIC WORKS DEPARTMENT 31. File and process a tract map. 32. Obtain an excavation permit, pay fees and post surety for all work in the public right-of-way. 34. Pay a pr-rata share of area -wide infrastructure improvements and traffic mitigations currently identified in a manner described by the City Engineer and approved by the City Council. 35. Office traffic shall not be allowed ingress or egress to Michael Drive. A control device will be included in the development to prevent this situation. 36. A parking management plan which includes a resident parking manager will be included in the development to ensure that the control measure is effective and operable. 37. Landscaping - Open Space: The applicant shall provide a detailed open space/landscape plan illustrating an urban landscape design for the upper deck area, consistent street frontage landscaping, provision of added open space and revised site plan illustrating 68 units and final parking layout, which shall be subject to the review and approval of the Site and Architectural Review Committee. 38. Parking: The applicant shall record a covenent obligating existing and future property owners to mitigate spill over parking problems if they are deemed to exist by the Campbell City Council. The mitigation measures may include but are not necessarily limited to the following: 1. Implement an office car pool program. 2. Implement a program encouraging employee ridership of alternate means of transportation. 3. Implement a valet parking program for the office component. 4. Limit the number of employees permitted to occupy the office structure. 5. Other methods determined to be reasonable by the City Council.
