CC Resolution 12979 - 2022 Military Equipment Annual ReportRESOLUTION NO. 12979 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CAMPBELL FINDING THAT EACH TYPE OF MILITARY EQUIPMENT IDENTIFIED IN THE 2022 MILITARY EQUIPMENT ANNUAL REPORT COMPLIES WITH THE STANDARDS FOR APPROVAL AS SET FORTH IN ORDINANCE 2280 AND AUTHORIZING THE CONTINUED USE OF MILITARY EQUIPMENT IN COMPLIANCE WITH ASSEMBLY BILL 481 WHEREAS, on September 30, 2021, Governor Gavin Newsom signed into law Assembly Bill 481 (creating Government Code Section 7070, et. seq.), relating to the use of military equipment by California law enforcement agencies; and, WHEREAS, AB 481 seeks to provide transparency, oversight, and an opportunity for meaningful public input on decisions regarding whether and how military equipment is funded, acquired, or used; and, WHEREAS, the Campbell Police Department is in possession of certain items of equipment that qualify as "military equipment" under AB 481; and, WHEREAS, the City Council of the City of Campbell on May 3rd, 2022, having received the information required under AB 481 regarding the Campbell Police Department's use of military equipment as defined in AB 481, deemed it to be in the best interest of the City to approve the Military Equipment Policy with their adoption of Ordinance 2280; and, WHEREAS, the Police Department submitted an annual military equipment report to the City Council, containing the information required in Government Code Section 7072, for the City Council to determine whether each type of military equipment identified in the annual report has complied with the standards for approval set forth in Ordinance 2280; and, WHEREAS, the City Council reviewed Ordinance 2280, the 2022 Military Equipment Annual Report, and voted to approve the continued use of the military equipment, in accordance with Government Code Section 7071(e)(2). NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Campbell does hereby find that each type of military equipment identified in the annual report has complied with the standards for approval set forth in Ordinance 2280; and, authorizes the continued use of military equipment after reviewing the 2022 Military Equipment Annual Report in compliance with Assembly Bill 481.
