A RESOLUTION OF THE COUNCIL OF THE CITY OF CAMPBELL AUTHORIZING THE
CITY MANAGER TO EXECUTE A SERVICE AGREEMENT WITH ENVIRONMENTAL
SERVICES INCORPORATED (ESI) FOR THE PURCHASE AND INSTALLATION OF
THREE (3) YORK HEATING, VENTILATION, AND AIR (HVAC) UNITS, IN AN AMOUNT
NOT TO EXCEED $64,980, FOR THE CAMPBELL COMMUNITY CENTER C-WING
BUILDING; AND DISPENSE WITH BIDDING REQUIREMENTS AS SPECIFIED IN
CAMPBELL MUNICIPAL CODE SECTIONS 3.20.030 (7) (8)
WHEREAS, the Campbell Community Center property was once home to Campbell High School
and purchased by the City from the Campbell Union High School District in 1985; and
WHEREAS, the Community Center is currently home to the City's Recreation and Community
Services Department, with the C-Wing building serving as the main office for department staff; and
WHEREAS, the C-Wing building has three HVAC units located on the breezeway roof which have
been in operation for approximately 25 to 30 years; and
WHEREAS, a recent assessment of one unit uncovered a significant amount of deterioration
through the system's components and heat exchanger that displayed signs of a potential fire
hazard; and
WHEREAS, the other two units have also experienced an increase in repairs and declining
conditions in recent years; and
WHEREAS, while staff has taken appropriate measures to address these recent issues, this will
not provide the long-term solutions for systems that have reached the end of their expected useful
life; and
WHEREAS, in an effort to reduce long-term energy use and reduce future maintenance costs, staff
is recommending the replacement of all three HVAC units for the C-Wing building; and
WHEREAS, based on their past successful work history with the City, staff contacted
Environmental Services Incorporated (ESI) to evaluate the current situation and recommend a
replacement strategy; and
WHEREAS, ESI has demonstrated the ability to provide service to City facilities in a manner that
provides high quality and timeliness, which reduces downtime; and
WHEREAS, ESI has developed and submitted a proposal, in the amount of $64,980, for the
purchase of three (3) York HVAC units, including the labor and specialized equipment required for
the removal of the existing units and installation of new ones; and
WHEREAS, this procurement strategy requires City Council to authorize staff to dispense with
bidding requirements as authorized in the Campbell Municipal Code Sections 3.20.030 (7) (8); and
WHEREAS, sufficient funding is available for the recommended work in the FY 2023 Operating
Budget for Public Works — Building Maintenance (Program 780).
NOW, THEREFORE, BE IT RESOLVED that the Council of the City of Campbell hereby
authorizes:
The City Manager of the City of Campbell execute a service agreement with Environmental
Services Incorporated (ESI) for the purchase and installation of three (3) York Heating,
Ventilation and Air Conditioning (HVAC) Units, in an amount not to exceed $64,980, for the
Campbell Community Center C-Wing Building; and
2. Dispense with bidding requirements as authorized in Campbell Municipal Code Sections
3.20.030 (7) (8), for the purchase of equipment that can only be obtained from one vendor
and/or when the City Council, by majority vote, determines that dispensing of such bidding
requirements is in the best interest of the public and shall prescribe the appropriate purchasing
method(s) to be used in its place.
