CC Resolution 12986 - Issuance of Affordable Housing Nexus Studies RFPRESOLUTION NO. 12986 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CAMPBELL AUTHORIZING THE COMMUNITY DEVELOPMENT DIRECTOR TO ISSUE A REQUEST FOR PROPOSALS (RFP) FOR PREPARATION OF AFFORDABLE HOUSING NEXUS STUDIES AND AUTHORIZING THE CITY MANAGER TO EXECUTE A CONTRACT WITH THE SELECTED SERVICE PROVIDER IN AN AMOUNT NOT TO EXCEED $150,000. WHEREAS, on April 18, 2023, the City Council adopted the City's 61h Cycle Housing Element; and WHEREAS, the 6th Cycle Housing Element identifies programs to modify the City's Inclusionary Housing Ordinance and establish a Commercial Linkage Fee as follows: Program H-1 a: Inclusionary Housing Ordinance Implementation: Amend the Inclusionary Housing Ordinance to offer developers a menu of options for achieving affordability, adjusting the percentage of units required to be affordable depending on the degree of affordability achieved (i.e., moderate-, low-, very low-, and extremely low income). These amendments could also include: Initiating a nexus study to reevaluate increasing the affordable housing in -lieu fee. Updating the inclusionary ordinance to require for -sale projects to provide the same allocation of units available to lower -income and very low-income units that is required for rental projects. " Modifying the In -Lieu Fee threshold to apply only to developments of 5-9 units. Housing developments of 10 or more units would not be allowed to substitute affordable units with in -lieu fees. Program H-1b: Commercial Linkage Fee: Establish an affordable housing impact fee that will apply to nonresidential development to provide an additional local source of revenue to support production of affordable housing. and WHEREAS, the 6th Cycle Housing Element identifies that nexus studies supporting the preparation of these ordinance amendments and fees will be completed by the end of December 2023-land WHEREAS, nexus studies are required to document the City's legal right ("nexus") to require affordable housing or the payment of affordable housing fees; and WHEREAS, the City Council has reviewed and accepted the draft RFP and found it to include the appropriate tasks needed to assist the Community Development Department in preparing the nexus studies required by the 6th Cycle Housing Element; and WHEREAS, the current FY 2023 Budget identifies an allocation of $150,000 in the Community Development Department Budget for the preparation of nexus studies. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Campbell hereby authorizes the Community Development Director to issue a Request for Proposals (RFP) for preparation of an affordable housing nexus studies and authorizing the City Manager to execute a contract with the selected service provider in an amount not to exceed a combined total of $150,000.
