PARR AVENUE), AND DIRECTING THE CITY CLERK TO RECORD THE RESOLUTION RESOLUTION NO. 12984 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CAMPBELL VACATING THE LIGHT AND AIR / BUILDING LINE (BUILDING SETBACK LINE) WITHIN LOT 15 OF TRACT MAP NO. 148 (621 W. PARR AVENUE), AND DIRECTING THE CITY CLERK TO RECORD THE RESOLUTION WHEREAS, on August 12t1, 1940, easements for light and air were recorded on Tract Map No. 148 (621 West Parr Avenue) in Book 4 of Maps, Page 55, of Official Records, Santa Clara County, and WHEREAS, on February 15th, 2023, the City of Campbell's Planning Division received a Zoning Clearance Application (PLN-2023-31) in support of an SB-9 Urban Lot Split Application (ENG-2023-64) to subdivide the property at 621 West Parr Avenue (Property No, 15 on Tract Map) into two (2) parcels for residential uses; and WHEREAS, the City's current Zoning Ordinance would allow for the 12-foot side setback being proposed, however, the County's existing 25-foot Building Setback Line along the Walnut Drive frontage creates a conflict with the proposed layout; and WHEREAS, the 25-food easement for Light and Air / Building Line is no longer required and has since been superseded by the setback requirements for the City of Campbell's Zoning Code; and WHEREAS, it is the desire of the City of Campbell to remove this outdated encumbrance (Light and Air / Building Line) from the property commonly known as 621 W. Parr Avenue, Campbell, California 95008; and WHEREAS, the easement vacation is to be made pursuant to Chapter 4, Summary Vacation, of Part 3 of Division 9 of the California Street and Highway Code. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Campbell does hereby vacate the Light and Air / Building Line Easement within Lot 15 of Tract No. 148 recorded in Book 4 of Maps at Page 55 of Official Records, Santa Clara County, and directs the City Clerk to record this resolution.
