CC Resolution 13015 - Agreement with SJWC Amount Not to Exceed $218,473RESOLUTION NO. 13015 A RESOLUTION OF THE COUNCIL OF THE CITY OF CAMPBELL APPROVING AN AGREEMENT WITH SAN JOSE WATER COMPANY (SJWC) TO PROVIDE EQUIPMENT AND LABOR SERVICES, IN AN AMOUNT NOT TO EXCEED $218,473, FOR THE INSTALLATION OF WATER UTILITY SERVICE CONNECTIONS FOR THE MEASURE_0 - CAMPBELL POLICE OPERATIONS BUILDING PROJECT (NO. 23-RR); AUTHORIZING THE CITY MANAGER TO EXECUTE SAID AGREEMENT AS SPECIFIED IN CAMPBELL MUNICIPAL CODE SECTION 3.20.100; AND AUTHORIZING THE PUBLIC WORKS DIRECTOR TO NEGOTIATE AND EXECUTE CONTRACT CHANGE ORDERS UP TO AND WITHIN THE ALLOCATED 10% CONSTRUCTION CONTINGENCY AMOUNT (RESOLUTION/CONSENT) WHEREAS, San Jose Water Company (SJWC), a California corporation, provides residential and commercial water services to communities throughout the greater San Jose area, including the City of Campbell; and WHEREAS, SJWC is part of the City's utility plan check review process when a project's scope of work requires the installation of a new connection to these metered water services (or making repairs to existing lines); and WHEREAS, per the City's utility plan check review, the Police Operations Building Project (No. 23- RR) is also subject to local fire protection codes -involving the relocating, removing, or abandoning of old facility connections and/or the installation of new facility water improvements and services; and WHEREAS, in addition, the project will be constructed on a site with no existing utility lines and is located within SJWC's right-of-way/jurisdiction for all metered water services; and WHEREAS, based on this jurisdiction, SJWC is -the only agency permitted to install the required utility connections that comply with the local fire protection codes; and WHEREAS, to meet these requirements, the City requested a proposal from SJWC for the installation of the project's required water utility lines and meter connections; and WHEREAS, after reviewing the project's plans, SJWC submitted a proposal to the City for equipment and labor services to install the building's fire hydrant connection, fire protection service connection, and domestic water metered service connection, for an estimated total cost of $218,473-, and WHEREAS, upon receiving this proposal, the City issued an engineering deposit in the amount of $12,000 to facilitate SJWC's development of the proposed installation plan,. resulting in a remaining balance of $206,473; and WHEREAS, change orders may be executed for additional expenses incurred as a result of unforeseen circumstances, up to and within the 10% construction contingency amount allocated for this project ($21,847). NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of Campbell hereby: 1) approve the agreement with San Jose Water Company for equipment and labor services to install the water utility service connections for the Campbell Police Operations Building Project (No. 23- RR) in an amount not to exceed $218,473; 2) authorize the City Manager to execute said agreement as specified in Campbell Municipal Code Section 3.20.100; and 3) authorize the Public Works Director to negotiate and execute contract change orders up to and within an allocated 10% construction contingency amount.
