A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CAMPBELL
TO AWARD THE PROJECT TO THE LOWEST RESPONSIBLE BIDDER, RADIUS EARTHWORK,
INC.; APPROVE THE CONSTRUCTION CONTRACT IN THE AMOUNT OF $1,212,910 PLUS
$121,290 CONSTRUCTION CONTINGENCY; AUTHORIZE THE CITY MANAGER TO EXECUTE THE
CONTRACT; AND AUTHORIZE THE CITY ENGINEER TO NEGOTIATE AND EXECUTE CONTRACT
CHANGE ORDERS UP TO AND WITHIN THE ALLOCATED CONSTRUCTION CONTINGENCY
WHEREAS, the City the City Council adopted Resolution No. 12970 approving the plans and
specifications, and authorizing the advertisement of bids for the Camden Avenue Resurfacing Project; and
WHEREAS, on May 24, 2023, the City received and publicly opened three bid proposals; and
WHEREAS, Radius Earthwork, Inc. of Campbell, California submitted the lowest responsible bid proposal
with a total base bid amount of $1,198,909.67; and
WHEREAS, West Valley Sanitation District requested the City to include an additive alternate in the
amount of $14,000, bringing the total contract amount to $1,212,910; and
WHEREAS, Radius Earthwork, Inc. was non -compliant with one instruction from the Notice of Inviting Bids
to download the bid documents from QuestCDN; and
WHEREAS, Radius, Earthwork, Inc. obtained the bid documents from a plan room, Bay Area Builders
Exchange; and
WHEREAS, according to the City Attorney, downloading bid documents is not material to the bid proposal;
and
WHEREAS, Radius Earthwork, Inc. as required, provided a Confirmation of Document Review to certify
they obtained, reviewed, and considered all published bid documents in the preparation of the submitted
project bid; and
WHEREAS, staff deem the bid proposal complete, responsive, and responsible; and
WHEREAS, a 10% construction contingency is commonly included to address any unforeseen situation
which may arise during construction; and
WHEREAS, the project budget has sufficient funds to support the award of the construction contract.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Campbell hereby award the
project to the lowest responsible bidder, Radius Earthwork, Inc.; approve the construction contract in the
amount of $1,212,910 plus $121,290 construction contingency; authorize the City Manager to execute the
contract; and authorize the City Engineer to negotiate and execute contract change orders up to and within
the allocated construction contingency.
