A RESOLUTION OF THE COUNCIL OF THE CITY OF CAMPBELL AUTHORIZING THE
EMERGENCY REPAIR OF THE COMMUNITY CENTER GAS UTILITY LINES BY WAY OF
EQUIPMENT AND LABOR SERVICES PROVIDED BY BURR PLUMBING IN THE AMOUNT
OF $122,177.30 AND DISPENSING WITH FORMAL BIDDING PROCEDURES AS SPECIFIED
IN CAMPBELL MUNICIPAL CODE (CMC) 3.20.050, AND SECTION 3.20.030(3) FOR
EMERGENCY SITUATIONS THREATENING THE HEALTH, SAFETY, OR WELFARE OF THE
PUBLIC THAT NECESSITATES THE DISPENSATION OF FORMAL BIDDING PROCEDURES;
AND AUTHORIZING A BUDGET ADJUSTMENT THE IN THE AMOUNT OF $122,177.30
(RESOLUTION/CONSENT)
WHEREAS, since 1985, the Campbell Community Center has been home to the City's Recreation
and Community Services Department and hosts a variety of programs that operate seasonally
and/or year-round; and
WHEREAS, one of the Community Center's largest (and oldest) mechanical systems is the original
gas lines that were installed during the late 1960's; and
WHEREAS, this underground system operates through a shared network of steel gas lines to
power various buildings and/or amenities located throughout the complex; and
WHEREAS, in April 2023, the Public Works Department's Building Maintenance Division was
notified by PG&E gas technicians that a severe leak was detected within the Community Center's
gas lines; and
WHEREAS, staff contacted Burr Plumbing for the specialized equipment and labor services
needed to assist staff 's efforts with locating the exact source of the leak and identifying a solution
to repair the impacted gas line(s); and
WHEREAS, the circumstances prompting staffs request also permitted the City to dispense with
formal bidding procedures as specified in Campbell Municipal Code (CMC) § 3.20.050, and Section
3.20.030(3), which states that an emergency situation creating a threat to the public health, safety
or welfare may necessitate the suspension of these bidding procedures; and
WHEREAS, Burr technicians arrived at the Community Center to, locate and identify multiple leaks
along different locations of the main gas line; and
WHEREAS, during the following weeks, Burr assisted staff with locating additional leaks,
implementing repairs, and installing a new line to the pool's machine room to help bring its boiler
system back online; and r
WHEREAS, despite the repairs performed to -date, the system still presented leakages throughout
the old pipe work that required additional repairs and replacements; and
WHEREAS, in early June 2023, the City received an invoice from Burr Plumbing in the amount of
$122,177.30 for all work performed to -date on the gas line leaks detected at the Community Center;
and
WHEREAS, staff directed Burr to refrain from additional repairs until a scope of work was prepared
to address the remaining issues; and
WHEREAS, staff is requesting City Council's approval of funding in the amount of $122,177.30 for
the emergency repair of the Community Center gas utility lines as outlined in the Burr Plumbing
invoice for services rendered between April and June of 2023; and
WHEREAS, should the City Council approve this allocation, payment will be issued to Burr
Plumbing and reflected as an expenditure from the Public Works Building Maintenance Operating
Budget for FY 2022/23; and
WHEREAS, a budget adjustment is required to address the funding required to perform this work.
NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of Campbell hereby
approves the. emergency repair of the Community Center gas utility lines to date by way of
equipment and labor services provided by Burr Plumbing, in the amount of $122,170.30, and the
dispensation of formal bidding procedures as specified in Campbell Municipal Code (CMC) §
3.20.050, and Section 3.20.030(3), for emergency situations necessitating the suspension of these
bidding procedures; and authorizes a budget adjustment in the amount of $122,170.30 for these
purposes.
BE IT FURTHER RESOLVED that staff will return to City Council to present the details of additional
repairs to be performed on the Community Center gas lines and request approval to proceed with
the proposed work and associated costs at that time.
