CC Resolution 13054 - DCBA Special Event PermitsRESOLUTION NO. 13054 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CAMPBELL AUTHORIZING THE ISSUANCE OF A DOWNTOWN SPECIAL EVENT PERMIT TO THE DOWNTOWN CAMPBELL BUSINESS ASSOCIATION FOR THE CREEPY CRAWLY HALLOWEEN EVENT, THE CAROL OF LIGHTS EVENT, AND THE BUNNIES AND BONNETS PARADE; AUTHORIZING A SPECIAL EVENT FEE WAIVER FOR ALL THREE EVENTS; AND AUTHORIZING A FIVE-YEAR TERM FOR EACH DOWNTOWN SPECIAL EVENT PERMIT. WHEREAS, after due consideration of all the evidence presented, the City Council did find as follows: 1. The event sponsor, the Downtown Campbell Business Association (DCBA) is a local civic, non-profit institution; 2. The date and hours of operation for the Creepy Crawly Halloween Event in Calendar Year 2023 will be as follows: Sunday, October 29t", 2023, 4:00 p.m. — 6:00 p.m. 3. The date and hours of operation for the Carol of Lights Event in Calendar Year 2023 will be as follows: Saturday, December 2"d, 2023, 3:00 p.m. — 7:00 p.m. 4. The date and hours of operation for the Bunnies and Bonnets Parade in Calendar Year 2024 will be as follows: Saturday, March 30th, 2024, 12:00 p.m. — 1:30 p.m. 5. The events will be located along Campbell Avenue between Railway Avenue and Third Street and utilize the cross streets between Civic Center and Orchard City Drive; 6. The above events are "Community Spirit Events" and will be non-alcoholic and non - fundraising events; and 7. The DCBA has successfully presented these types of events annually for over the last 20 years; WHEREAS, based on the foregoing findings of fact, the City Council further finds and concludes that for each event the following are true: 1. The special event will not disrupt to an unreasonable extent, the movement of traffic or create any safety hazard as a result of such other traffic being stopped or diverted; 2. Sufficient Police service can be provided to assure proper traffic control, security, and the orderly conduct of the special event; 3. The streets and roads over which the special event will be conducted are sufficient size and construction to safely accommodate the number of participants and the size, height and weight of any vehicles or equipment participating in the event; 4. The special event will not interfere with any other public events to be conducted on the same day; 5. The special event is not likely to cause injury to persons or property or create an unreasonable disturbance of the peace; 6. The cumulative impact of this special event will not create an undue strain on public resources; and 7. Each event constitutes one event that is present annually in the City. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Campbell does hereby authorize a Special Event Permit to be issued to the Downtown Campbell Business Association for the Creepy Crawly Halloween Event, the Carol of Lights Event, and the Bunnies and Bonnets Parade with each event to be held at the location set forth in this resolution once per year for the next five years beginning from the date of this resolution; and, does hereby authorize the 100% waiver of all fees associated with the three permits, subject to the following conditions of approval: Conditions of Approval 1. The dates and hours of operation for each subsequent annual Creepy Crawly Halloween Event, Carol of Lights Event, and Bunny and Bonnets Parade shall be approved by the Chief of Police and City Manager upon determination that the City will have adequate resources available to assure proper traffic control and the orderly conduct of the special event; 2. No alcohol will be sold or allowed at any of these special events; 3. No fundraising shall occur at any of these special events; 4. The DCBA shall be subject to the insurance requirements set forth in Chapter 11.30 of the Campbell Municipal Code for each of these special events; and 5. The DCBA shall ensure that each of these special events complies with all applicable policies and ordinances of the City of Campbell.
