CC Resolution 13070 - Vacation of the Light and Air Parsons Ave, Fairbanks Ave, Sharp Ave, Sharp Court RESOLUTION NO. 13070 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CAMPBELL VACATING THE LIGHT AND AIR/ BUILDING SETBACK LINE EASEMENTS AS SHOWN ON TRACT MAP NO. 1314 (PORTIONS OF PARSONS AVENUE, FAIRBANKS AVENUE, SHARP AVENUE, AND SHARP COURT), AND DIRECTING THE CITY CLERK TO RECORD THE RESOLUTION WHEREAS, an easement for light and air purposes was recorded on January 25, 1955 on Tract Map No. 1314 (portions of Parsons Avenue, Fairbanks Avenue, Sharp Avenue, and Sharp Court) in Book 54 of Maps at Pages 22-23 of Official Records, Santa Clara County; and WHEREAS, the 25-foot front Building Setback Line and 12.5-foot side street Building Setback Line shown on the Tract Map are not consistent with the corresponding setbacks specified in the Campbell Zoning Code, thereby creating conflicts between the two different requirements; and WHEREAS, this easement is no longer required as it has been superseded by the requirements of the City of Campbell Zoning Code; and WHEREAS, it is the desire of the City of Campbell to remove this outdated encumbrance from the properties within the subdivision known as Tract No. 1314 as shown on Exhibit A and more particularly described in Exhibit B; and WHEREAS, the easement vacation is to be made pursuant to Chapter 4, Summary Vacation, of Part 3 of Division 9 of the California Street and Highway Code. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Campbell does hereby vacate the light and air/building setback line easement and directs the City Clerk to record this Resolution for the properties within Tract No. 1314, excluding any property in the City of San Jose, as shown on Exhibit A and more particularly described in Exhibit B.
