A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CAMPBELL
ACCEPTING THE VIRGINIA PARK IMPROVEMENTS PROJECT NO. 20-QQ AND
DIRECTING THE CITY ENGINEER TO FILE THE NOTICE OF COMPLETION
WHEREAS, in June 2022, the City Council approved the Virginia Park Improvements
Project (No. 20-QQ) as part of the City's Capital Improvement Plan (CIP) for Fiscal Years
2023 —2027 and funded through the City's Par Dedication Fund; and
WHEREAS, in November 2022, staff from the Public Works Maintenance Division
discovered significant deterioration of Virginia Park's original wooden playground
structures, prompting staff to immediately tag the equipment for closure and recommend
advancing the project's implementation to the (then) current fiscal year (FY23); and
WHEREAS, staff worked with Miracle Play Systems (Miracle) to develop an improvement
plan for Virginia Park that expanded accessibility of amenities while enhancing the park's
overall appearance; and
WHEREAS, the City's membership with Sourcewell (a Cooperative Purchasing Firm)
allowed staff to procure these goods and services from Miracle at a discounted rate, and -
in place of the standard Request for Qualifications (RFQ) process as specified in the
provisions of the Campbell Municipal Code Section 3.20.30(6); and
WHEREAS, after discussions during the February 1, 2023, Parks and Recreation
Committee (PRC) meeting, members voted to approve a recommendation in support of
staffs proposed plans and early commencement of the Project; and
WHEREAS, on February 28, 2023, the City Council adopted Resolution No. 12938,
authorizing the project to commence during the current fiscal year (FY23), awarding a
contract to Miracle Play Systems for the associated design and installation services, and
authorizing the Finance Director to execute a budget adjustment to reflect the project's
total cost of$110,000 as programmed in its CIP budget; and
WHEREAS, the Virginia Park Improvement project began construction on June 20, 2023,
and was completed on August 18, 2023; and
WHEREAS, during its construction, Miracle Play Systems and staff removed the existing
wood fiber, concrete walkway, and play structure, and completed the installation of the
new MREC 2-5 play structure, wood fiber, and ADA-compliant gate; and
WHEREAS, upon its completion, the project's total costs were $109,599; and
WHEREAS, based on its current CIP budget of$110,000, the balance of$401 in unspent
project funds will be returned to the Parkland Dedication Fund and applied towards other
improvement projects as programmed in the City's current CIP.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Campbell
hereby accepts the improvements for the Virginia Park Improvements Project No. 20-QQ
and directs the City Engineer, or their designee to file a Notice of Completion.
