Garland Spears on Curtner Avenue
My involvement began prior to Mr. Spear's acquisition of
excess property from State or City.
Mr. Spears contacted contractors for estimates on installa-
tion of sanitary sewer lateral. Contractors in turn
contacted me for specifics.
Later, two electroliers were installed.
Then concrete driveway was installed.

Curb revision is
During the course of aforementioned construction, Mr. Spears
asked me if he could fence and utilize some of the public
right of way for parking trailers. I gave Mr. Spears
permission to place fence 4 feet from curb on the westerly
side of westerly driveway.
Mr. Spears has contacted me many times on matters over which
I had no jurisdiction, and I informed him of this.

BEING A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF CAMPBELL, COUNTY OF SANTA CLARA, STATE
OF CALIFORNIA, AUTHORIZING THE SALE OF REAL
PROPERTY.
WHEREAS, the City of Campbell did heretofore on September 1, 1972,
acquire that certain real property described upon that certain instru-
ment entitled "Relinquishment of Highway Right of Way in the City of
Campbell, Road 04-SCl-17-l0.1-10.7 Request No. 40255" recorded Septem-
ber 1, 1972, and filed in Book 0003 of Official Records at Pages 545
and 546 in the office of the County Recorder of the County of Santa
Clara, State of California; and,
WHEREAS, said real property was granted to said City of Campbell
as right of way for a frontage road known as Curtner Avenue, formerly
known as Casey Road; and,
WHEREAS, land in excess of that which is necessary for said Curtner
Avenue was granted to said City of Campbell, the sale of which excess
land and/or the exchange of which, for a valuable consideration, is in
the best interest of the citizens of said City of Campbell and of the
public in general; and,
NOW, THEREFORE, BE IT AND IT IS MUTUALLY RESOLVED by the City
Council of the City of Campbell that in and for a valuable consideration,
receipt of which is hereby acknowledged, the sale or exchange of said
real property, a description of which is hereto attached and by
reference made a part hereof, be made. The Mayor and the City Clerk
are hereby authorized and directed to execute an instrument of convey-
ance of said real property and to record said instrument in the office
of the County Recorder of the County of Santa Clara.

The State of California has recently relinquished land
to the City of Campbell, a portion of which land the City
will be selling as excess.
The portion of land which the City is selling at this
time is shown and described upon the attachments to this
letter. If your Company has any facilities within this
property and you wish to retain an easement for them, please
advise this office. We are interested in having a legal
description of the land your existing facilities occupy.
Please contact this office by Tuesday, October 10, 1972.
If no comments are received by this office by that date, it
will be understood that no comments will be forthcoming.

Section
21.42.090 of the Campbell Municipal Code reads as follows:
Any approval granted under this section shall expire one year after
the date upon which such app~oval was granted, unle3s an extension
for such approval is obtained by making written application for same
to the Planning Commission at least fifteen (15) days prior to the
expiration date of such approval.
No building permit shall be issued after the expiration date of any'
approval until a new approval has been obtained in the manner provided
for in this Chapter.

Property to be fenced and landscaped as indicated and as added
in "redll on plans.

Landscape plan indicating location of hose bibs or sprinkler
system and type of fencing to be submitted for approval of
the Planning Director at time of application for building
permit. All planter areas to be enclosed Hithin 4" to 6"
raised concrete curbs.
3.
Landscaping shall be maintained in accordance with the approved
landscape plan.
4.
Faithful performance bond in the amount of $1,500 to be posted
to insure landscaping, fencing and striping of parking area
within three (3) months of completion of construction, or
applicant may file written agreement to complete landscaping,
fencing and striping of parking area prior to final building
department clearance.
5.
Trash container(s) of a size and quantity necessary to serve the
development shall be located in area(s) approved by the fire
department. Unless otherwise noted, enclosure(s) shall consist
.of a concrete floor surrounded by a solid wall or fence and
have self-closing doors of a size specified by the fire department.
The applicant is notified as part of this application that he is
required to meet the following conditions in accordance with Ordinances
of the City of Campbell.
A.
All parking and driveway areas to be developed in compliance with
Section 21.50.010 of the Campbell Municipal Code. All parking
spaces to be provided with appropriate concrete curbs or bumper
guards.
B.
Underground utilities to be provided as required by Section
20.16.070 of the Campbell Municipal.
c.
Plans submitted to the building department for plan check shall
indicate clearly the location of all connections for underground
utilities including water, sewer, electric, telephone and
television cables, etc.
D.
Sign application to be submitted in accordance with provisions
of the sign ordinance for all signs. No sign to be installed
until application is approved and permit issued by the building
department.
E.
Roof covering and in-lot draina;e to be indicated on plan~
presented for building rcrm~t.
F.
