WHEREAS public hearing has been held in the manner
specified by law on the application of Richard Sgarlato for a use
permit to establish a towing and storage yard for Dick's Automotive
Center on property located at 210 Curtner Avenue, as per applica-
tion filed in the office of the Planning Department on Scptemb~r 29,
1970; and
WHEREAS after oral presentation by the Planning Director,
proponents and opponents, the hearing was closed; and
WHEREAS after discussion of all evidence presented the
Commission did find as follows:
That the establishment, maintenance or operation of
the use applied for will not be detrimental to the
health, safety, peace, morals, comfort or general
welfare of persons residing or working in the
neighborhood of such proposed use.

That the proposed use will not be detrimental or
injurious to {he properties and improvements in the
neighborhood or the general welfare of the City.
NOW, THEREFORE, BE IT RESOLVED that the Planning Commission
of the City of Campbell does hereby approve the use as applied
for, subject to the following conditions:
Those conditions required for the operation of a
towing service and storage yard as specified in
Section 9314.3(5) and listed as follows:

The storage of wrecked or abandoned vehicl~s
shall be kept at all times within an area
completely enclose4 by a 6 ft. high solid
wall or sight-obscuring fence.
There shall be no stacking of wrecked or
abandoned vehicles.
There shall be no wrecking or dismantling of
autoDobiles or sale of automobile parts
from the premises other than the sale of
\-Treeked or abandoned vehicles as a Hhole to
a junk dealer or wrecking yard.
Area used for storage to be kept free of
miscél1aneous debris at all times.
~inimum gate opening to be 12 ft. in width,
and a minimum of l2 ft. to be maintained
between rows of automobiles to provide room
for fire department.

Storage yard to be paved as required by
Section 9319.
B.
Dedic~tion to 30 feet half street on Curtner Avenue
frontage.
C.
Property owner to enter into agreement and post
faithful performance bond for half street improve-
ments on CUrtner Avenue frontage.
D.
Payment of storm drainage fee in the amount of $340.
USE PERMIT SHALL NOT BECOME VALID PRIOR TO NOVEMBER l2,
1970.
