determines that a certain portion of SUnnyoaks Avenue, a public
street in the city of Campbell situate between Winchester Bouleva~d
and Dell Avenue, is not necessary for present or for prospective
public street purposes because said portion has been superseded by
relocation; and,
WHEREAS, said City Council finds and determines that it is in
the best interest and for the 'betterment of the general welfare of
the citizens of the City of Campbell and of the public at large that
said portion of SUnnyoaks Avenue be vacated; and,

Disposal of Excess Riqht-of-way
Dell Avenue and Sunnyoaks Avenue
Dear Mr. Hodge:
A portion of SUnnyoaks Avenue, between Winchester Boulevard
and Dell Avenue,. is no longer in use as a public street since
Unit 5B of the San Tomas Expressway was constructed and Dell
Avenue was extended. This office is preparing to transfer
title of this excess right-of-way to the property owners of the
parcel of land adjoining on the south, so that the area will
be landscaped and maintained.
It is our intention to retain a public service easement
over/under the entire parcel.
The County acquired title to property for the Dell Avenue
extension. A small piece of County property, that appears to
be excess, adjoins the old Sunnyoaks right-of-way on the north.
Please see the attached plat showing the City parcel as
Parcel A and the County parcel as Parcel B. It is our feeling
that the County may wish to transfer title of Parcel B so that
it too may be landscaped and maintained by the same property
owners.
The subject property owners, Tony R. Kovac and Nickie P.
Kovac, have contracted an engineering firm to process a Parcel
Map when the final parcel configuration is determined.
