Dear Mr. Higgins:
In reply to your letter of June 10, 1968 regarding
the Deleco Corporation1s street improvements, the City
does not have much additional information to offer
at this time.
To date, we have not been able to secure an assessment
district petition from a sufficient majority of the
property owners on Dell Avenue to proceed with the project.
We are hopeful that this situation will change and have
received some encouragement in that regard.

you and your client.

BEING A RESOLUTION AUTHORIZING EXECUTION
OF DELECO CORPORATION OF CALIFORNIA AGREEMENT.
WHEREAS, there has been submitted to the City Council
by Deleco corporation of California an ågreement for the
development of their real property in accordance with
prescribed conditions; and,
WHEREAS, by the terms of said agreement, and
concurrently herewith they have submitted grant deeds of
certain portions of their property for street purposes;
NOW, THEREFORE, BE IT RESOLVED by the City Council
that the Mayor be and he is hereby authorized to execute
the said agreement on behalf of said City; and
BE IT FURTHER RESOLVED that the grant deed submitted
in connection therewith be and the same is hereby accepted.

This bank is informed that Deleco is constructing a plant at 1551 Dell Avenue,
Campbell, California. We further understand Deleco has agreed that if an assess-
ment district is not successful prior to January 1, 1969, in constructing public im-
provements embracing the above Dell Avenue property, Deleco will install street
1mprovements throughout its frontage on said property if requested to do so by the
Cify Council of Campbell. This Letter of Credit 1S to assure the City of Campbell
that in the event the as ses sment district is not successful by January 1, 1969, and
Deleco fails to install street improvements throughout its frontage after being called
upon to do so, the City of Campbell shall be authorized to draw on the account of
Deleco for the purpose of constructing said street improvements. All drafts drawn
under this Letter of Credit must be accompanied by a Certification that:

Deleco Corporation of California, Inc. has failed to install street im-
provements throughout its frontage ninety (90) days after the City
Council of Campbell requested that such installation be undertaken.
The request for payment is made pursuant to authority designated by
the City Council of the City of Campbell, California, and a copy of
an appropriate resolution is attached.
No demand for payment under this Letter of Credit will be honored which is received

Section 9316.1 of the Campbell Municipal Code reads as follows:
Any approval granted under this section shall expire one hundred eighty
(l80) days after the date upon which such approval was granted, unless
an extension for such approval is obtained by making written application
for same to the Planning Commission at least fifteen (15) days prior to
the expiration date of such approval.
No building permit shall be issued after the expiration date of any
approval until a new approval has been obtained in the manner provided
for in this chapter.
