Gentlemen:
We have made a Final Inspection of subject public works construction
and find it acceptable and in conformance with City standards. Accord-
ingly, the work is hereby accepted subject to the one-year maintenance
requirement indicated below.
You are responsible for the maintenance, repair and/or replacement of
all work done should any failures occur within one (1) year of this
date. To guarantee this, you must either post a maintenance bond in
the amount indicated above, or maintain your existing faithful per-
formance bond. If you post a separate maintenance bond, your current
bond will be released by separate action.
We will inspect the work in one year and advise you whether or not
maintenance is needed.

A G R E E MEN T

THIS AGREEMENT is between the CITY OF CAMPBELL, hereinafter called CITY,
and ROBERT GOGUEN, hereinafter called DEVELOPER.
DEVELOPER agrees to deposit SIX HUNDRED DOLLARS ($600.00) in cash or
cashier's check to cover the cost of completion of the required public works
improvements for 1610 Dell Avenue - Excavation Permit No. 79-44.
CITY agrees upon receipt of such deposit to release their hold on the
final building inspections.
DEVELOPER agrees to complete, or cause to be completed, all required public
works improvements as required by and to the satisfaction of the CITY Public
Works Department within ONE HUNDRED TWENTY (120) DAYS of the date of this
Agreement. DEVELOPER further agrees that should said improvements not be
completed within said time, he hereby allows and directs CITY to use said deposit
to cause the required improvements to be completed. DEVELOPER further agrees that
CITY may charge Ten Percent (10%) of the cost of the work as administration fees.
CITY agrees that upon CITY acceptance of DEVELOPER'S completion of the
required work, CITY will return DEVELOPER'S entire deposit.
'CITY further agrees to submit to DEVELOPER a cost accounting for all work
done and money spent, along with the balance of the deposit, if any, within FORTY-
FIVE (45) DAYS of completion of any work the CITY must have done in accordance
with this Agreement.

Section 21.42.090 of the Campbell Munjcipal Code reads as follows:
Any approval granted under this section shall expire one year after the
date upon which such approval was granted, unless an extension for such
approval is obtained by making written applicatión for same to the
Planning Commission at least fifteen (15) days prior to the expiration
date of such approval.
No building permit shall be issued after the expiration date of any approval
until a new approval has been obtained in the manner provided for In this
Chapter.

Applicant to submit a letter, satisfactory to the City Attorney,
to be recorded as a deed restriction limiting the use of the building
to 23,000 square feet of industrial uses and 11,300 square feet of
warehouse uses.
Property to be fenced and landscaped as indicated and as added in

Landscape plan indicating type of plant material, location of hose
bibs, or sprinkler system and typ~ of fencing to be submitted for

The applicant is notified as part of this application that he is required to
meet the following conditions in accordance with Ordinances of the City of Campbell.

All parking and driveway areas to be developed in compliance with
Section 21.50 of the Campbell Municipal Code. All parking spaces to
be provided with appropriate concrete curbs or bumper guards.

Underground utilities to be provided as required by Section 20.16.070 ~.
of the Campbell Municipal Code.

Plans submitted to the Building Department for plan check shall indicate
clearly the location of all connections for underground utilities,
including water. sewer, electric, telephone and television cables. etc.

Sign application to be submitted in accordance with provisions of the
sign ordinance for all signs. No sign to be Installed until application
is approved and permit issued by th~ Building Department.

Ordinance No. 782 of the Campbdl Municipal Code stipulates that any
contract for the collection and dispo~al of refuse. garbage, wet garbage,
and rübbish produced within the limits of the City of Campbell shall
be made with Green Valley Dispos~1 Company. This requirement applies
to all single family dwellings, multiple ap.rtft~nt units, to all
commercial. business, industrial, ..nufacturing. .nd construction
establishments.

We have reviewed the site plan for Campbell Industrial Building
on Dell Avenue, File Number S78-l, sent to us on January 13.
The site is adjacent to both Los Gatos Creek and the Upper Page
Distribution System. The site is not subject to flooding from
the 1% flood on Los Gatos Creek.
The District presently has sufficient channel right of way along
this reach and no additional right of way is required from this
site.
In accordance with District Ordinance 75-6, the owner should show
any existing well(s) on the plans and inform us regarding their
proposed use. Please contact Mr. Zozaya on extension 379 for
information about well permits.
Because it can affect the operations and maintenance of both
District facilities, we request that grading adjacent to the rights
of way be done in accordance with the enclosed sheets 20-20B.
The details of the grading should include the cross-sectional
view at the rights of way and should be done on the improvement
plans.
Site drainage can not be allowed to the Page Distribution System.
It would be desirable to incorporate the site's drainage into an
existing storm drainage system; however, if a storm drain outfall
into Los Gatos Creek is necessary, please have it designed to

needed. Please furnish outfall structure details for 01!r review

The creek may be a potential hazard to small children in the
area. We, therefore, recommend that the creek be fenced. Chain
link fence may be placed in accordance with the enclosed detail
sheet 17. Any other type should be installed off District's right
of way and maintained by others. Please show details of any fenc-
ing on the improvement plans.
Please furnish final plans for our review and issuance of a permit
prior to construction.
