BEING A RESOLUTION AUTHORIZING EXECUTION
OF RELEASE OF AGREEMENT WITH NOEL J, BROWN
FOR THE INSTAllATION OF A WATER MAIN IN
DIVISION STREET
WHEREAS a certain agreement dated May 31, 1966, and subsequently re-
corded in Book 7402 of Santa Clara County Official Records at page 354
et, seq. was entered into by and between Noel J. Brown, referred to
therein as OWNER, and the City of Campbell, a municipal corporation,
referred to therein as CITY, relative to construction of a water main
described therein; and
WHEREAS the owners, their successors or assigns have fulfilled all the
terms and provisions as contained in said agreement;
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of
Campbell does hereby release the owners as above set forth, their heirs,
successors, or assigns from all ob1 igations contained in said agreement,
and terminates said agreement.

RESOLUTION NO. 2028
After notification and public hearing as specified by law on the
application of Mr. Harold Osterlund for a six foot variance to the
front yard setback requirement to allow the construction of an 1,860
square foot office addition to an existing building on property known
as 541 Division Street in a CM:B-80 (Controlled Manufacturing) Zoning
District, as per the application filed in the Office of the Planning
Department on June 10,1981, and after presentation by the Planning
Director, proponents and opponents, the hearing was closed (V 81-02).
After due consideration of all the evidence presented, the Commission
did find as follows:
That the establishment, maintenance, and operation of the
proposed variance will not be detrimental to the health,
safety, peace, morals, comfort or general welfare of the
persons residing or working in the neighborhood of such
use, or be detrimental or injurious to property and improve-
ments in the neighborhood or the general welfare of the City.
Based on the above findings, the Planning Commission does hereby grant
the requested variance subject to the following conditions:
1. Approval of this variance application is subject to the
City Council abandoning an 8 foot strip of public right-of-
way along the Division Street frontage of this property.
2.
Applicant to submit an application for Site and Architectural
approval for the proposed addition.

The applicant is notified that he shall comply with all applicable
Codes or Ordinance of the City of Campbell which pertain to this develop-
ment and are not herein specified.
