The City Council of the City of Campbell does ordain as follows: SECTION ONE: That the Zoning Map of the City of Campbell is hereby changed and amended by adopting the attached "Exhibit A" entitled Plans and Elevations, "Exhibit B" entitled Development Schedule, "Exhibit C entitled Map of Said Property, and "Exhibit D" entitled Conditions of Approval, as per the application of Mr. Paul E. Crowley for approval of plans, elevations, and development schedule to allow construction of 8 condominium units on property known as 49 Dot Avenue in a Planned Development Zoning District. Copies of said Exhibits are on file in the Office of the Planning Department. The applicant is notified that he shall comply with all applicable Codes or Ordinances of the City of Campbell which pertain to this develop- ment and are not herein specified. Landscaping plan indicating type and size of plant material, and location of hose bibs or sprinkler system to be submitted for approval of the Planning Director and Site and Architectural Review Committee prior to application for building permit. C. Fencing plan indicating location and design details of fencing to be submitted for approval of Planning Director prior to application for building permit. D. Landscaping and fencing shall be maintained in accordance with the approved plan. E. Applicant to either (1) post a faithful performance bond in the amount of $5,000 to insure landscaping, fencing, and striping of parking areas within three months of completion of construction, or (2) file written agreement to complete landscaping, fencing and striping of parking areas prior to final Building Department clearance. F. All mechanical equipment located on roofs to be screened as approved by the Planning Director. G. All parking and driveway areas to be developed in compliance with Section 21.50 of the Campbell Municipal Code. All parking spaces to be provided with appropriate concrete curbs or bumper guards. H. Underground utilities to be provided as required by Section 20.16.070 of the Campbell Municipal Code. I. Plans submitted to the Building Department for plan check shall indicate clearly the location of all connections for underground utilities including water, sewer, electric, telephone and television cables, etc. J. Sign application to be submitted in accordance with provisions of the sign ordinance for all signs. No sign to be installed until application is approved and permit issued by the Building Department. (Section 21.68.070 of the Campbell Municipal Code.) K. Ordinance No. 782 of the Campbell Municipal Code stipulates that any contract for the collection and disposal of refuse, garbage, wet garbage and rubbish produced within the limits of the City of Campbell shall be with Green Valley Disposal Company. This requirement applies to all single-family dwellings, multiple apartment units, to all commercial, business, industrial, manufacturing, and construction establishments. .. CROWLEY 49 DOT AVENUE - CONSTRUCTION OF 8 CONDOMINIUM UNITS ---------------------------------------------------------- RECOMMENDATION That the City Council adopt the attached ordinance approving the application of Mr. Paul E. Crowley for approval of plans, elevations, and development schedule to allow construction of 8 condominium units on property known as 49 Dot Avenue in a P-D (Planned Development/Medium Density Residential) Zoning District. DISCUSSION The applicant is proposing to construct 8 condominiums on a 17,600 square foot lot resulting in a density of 20 units per acre. The first floor (garages) of the two proposed three-story structures will cover approximately 29 percent of the 0.40 acre site. Building materials are indicated as vertical wood siding with stucco and wood trim and red monray tile roofing. The applicant is providing 20 parking spaces (16 covered and 4 uncovered). The resulting parking ratio of 2~ spaces per unit satisfies the Code requirements for two-bedroom condominiums. The site plan indicates that 41 percent of the net lot area will be landscaped. The Architectural Advisor is of the opinion that the design is acceptable. At its meeting of October 2,1979 the Planning Commission unanimously adopted the attached resolution recommending approval of this application. Attach. jw " RESOLUTION NO. 1825 BEING A RESOLUTION OF THE PLANNING CO~4ISSION OF THE CITY OF CAMPBELL RECOMMENDING APPROVAL OF PLANS, ELEVATIONS, AND DEVELOPMENT SCHEDULE TO ALLOW THE CONSTRUCTION OF 8 CONDOMINIUM UNITS ON PROPERTY KNOWN AS 49 DOT AVENUE IN A P-D (PLANNED DEVELOPMENT/MEDIUM DENSITY RESIDENTIAL) ZONING DISTRICT. (APPLICATION OF MR. PAUL E. CROWLEY, PD 79-8.) Plans, elevations, and development schedule for 8 condominium units to be located on property known as 49 Dot Avenue in a P-D (Planned Development/ Medium Density Residential) Zoning District have been presented for approval by Mr. Paul E. Crowley. After notification and public hearing as specified by law on said proposed amendments, as filed in the Office of the Planning Department on July 6,1979, and after presentation by the Planning Director, proponents, and opponents, the hearing was closed. After due consideration of all evidence presented, the Planning Commission did find as follows: That the establishment, maintenance, and operation of the proposed use will not be detrimental to the health, safety, peace, morals, comfort or general welfare of the persons residing or working in the neighborhood of such use, or detrimental or injurious to property and improvements in the neighborhood or the general welfare of the City. Based on the above findings, the Planning Commission did recommend approval of plans, elevations, and development schedule as presented and further recommends that the City Council enact the Ordinance attached hereto as Exhibit "A", adopting said plans, elevations, and development schedule for that portion of the above mentioned Planned Development Zone.
