601 El Patio Dr. (77-24) PU' ORDINANCE NO. 1127 BEING AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CAMPBELL ADOPTING PLANS, ELEVATIONS AND DEVELOPMENT SCHEDULE FOR THE PLANNED DEVELOPMENT ZONE ESTABLISHED BY ORDINANCE OF THE CITY OF CAMPBELL. (Application of Mr. Paul W. Bosholm) The City Council of the City of Campbell does ordain as follows: SECTION ONE: That the Zoning Map of the City of Campbell is hereby changed and amended by adopting the attached "Exhibit A" entitled "Plans and Elevations", "Exhibit B" entitled "Development Schedule", and IIExhibit C" entitled "Map of Said Property", as per the application of Mr. Paul W. Bosholm for approval of plans, elevations, and development schedule to allow construction of a 57-uni~ single-family patio home style subdivision on property known as 601 El Patio Drive in a Planned Development Zoning District. Copies of said Exhibits are on file in the office of the Planning Department. Said approval subject to the following conditions: A. Detailed fence plan to be approved by the Planning Director. B. Roofing materials to be approved by the Planning Director. C. Landscape plan indicating type of plant material, location of hose bibs, or sprinkler system and type of fencing to be submitted for approval of the Planning Director at time of application for building permit. D. Landscaping shall be maintained in accordance with the approved landscape plan. E. Faithful performance bond in the amount of $3,000 to be posted to insure landscaping, fencing and striping of parking area within three (3) months of completion of construction, or applicant may file written agreement to complete landscaping, fencing and striping of parking area prior to final Building Department clearance. F. Architectural and site approval by the Planning Commission. G. All parking and driveway areas to be developed in compliance with Section 21.50 of the Campbell Municipal Code. All parking spaces to be provided with appropriate concrete curbs or bumper guards. H. Underground utilities to be provided as required by Section 20.16.070 of the Campbell Municipal Code. I. Plans submitted to the Building Department for plan check shall indicate clearly the location of all connections for underground utilities, including water, sewer, electric, telephone and television cables, etc. J. Sign application to be submitted in accordance with provisions of the sign ordinance for all signs. No sign to be installed until application is approved and permit issued by the Building Department. K. Ordinance No. 782 of the Campbell Municipal Code stipulates that any contract for the collection and disposal of refuse, garbage, wet garbage, and rubbish produced within the limits of the City of Campbell shall be made with Green Valley Disposal Company. This requirement applies to all single-family dwellings, multiple apartment units, to all commercial, business, industrial, manufacturing, and construction establishments. L. Trash container(s) of a size and quantity necessary to serve the development shall be located in area(s) approved by the Fire Department. Unless otherwise noted, enclosure(s) shall consist of a concrete floor surrounded by a solid wall or fence and have self-closing doors of a size specified by the Fire Department. All enclosures to be constructed at grade level. M. Applicant shall meet State requirements for the handicapped. PUBLIC WORKS DEPARTMENT N. Process and file a subdivision map. O. Enter into an agreement to participate in a Local Improvement District for improvement of those streets in the geographical area bounded by Campbell Avenue to the South, S.P.R.R. to the Northwest and Highway 17 to the Northeast. FIRE DEPARTMENT P. Provide three street fire hydrants. The water main shall be "looped" to insure proper distribution of water, and be capable of delivering 2,000 G.P.M. Q. No street parking on 20-foot wide streets. The applicant is notified that he shall comply with all applicable Codes or Ordinances of the City of Campbell which pertain to this development and are not herein specified. It has been the policy of Southern Pacific Transportation Comp~ny to oppose any new public grade crossings on operating tracKs. If a real need for a crossing exists within a community we insist on an over or under crossing to insure no interference with our operations. If this matter is to be pursued further, desire a formal proposal from the involved Public Agency in order to more fully study this particular crossing proposal. Bosholm of Im-Pac Development Company states that he will be requesting the City of Campbell to review a "Patio Horne" residential subdivision plan development proposal and that he is submitting this proposal to you. The development plan proposes to use all or portions of a strip of land owned by this District which contains a high- pressure water pipeline facility (Central Pipeline). This letter is to advise that the Grantors reserved to themselves (and thus to Bosholm as their successor) certain rights to the surface of said strip of land. The reservation, as stated on the deed to the District, is as follows: "Reserving, however, to Grantors, their successors or assigns the right to cross over said land to other property of Grantors and to use the surface of said land for commer- cial or industrial purposes; provided, that no trees or shrubs are planted thereon, no structures are placed there- on, and the location and the grades of any paving, lawns or other types of improvement placed thereon shall be first approved by the Santa Clara County Flood Control and Water Conservation District." It is our request and my understanding that plans for this development will be forwarded to the District for review and comment prior to the City of Campbell's approval.
