Campbell
Gentlemen:
It has recently been brought to our attention by the Assessor's
office of santa Clara County that there was a discrepancy with the
Grant Deeds by which the City of Campbell acquired certain rights
of way from a previous owner of the property which you now own.
I am enclosing a copy of the instruments which were executed by
Topaz Builders, recorded March la, 1966, and filed in Book 73l7 of
Official Records at pages ll3 and ll4. This document conveyed the
street right of way. The document which conveyed same portions of
a fifteen-foot-wide storm sewer easement was also recorded March la,
1966, and filed in Book 73l7 of Official Records at pages ll6 and
ll7.
'l'he problem is that at the time the documents were recorded,
March la, 1966, Topaz Builders were not the legal owners of some
portion of the property. At that particular t~e, valley Title
Company owned a portion of the property. As far as we. can tell,
the property is now owned by both of you.
In order to rectify the matter, we request that you execute the two
enclosed instruments and return them to us for acceptance and
recordation. If you will read the instruments which I am enclosing
for your execution, you will find that they describe the same property
which Topaz Builders intended to convey. We have done this in an
effort to once and for all rectify the error which was made.

Topaz Builders acquired all of subject property on November 19,
1964 - Book 6746, page 482.
2.
Topaz deeded a parcel to Valley Title on March 12, 1965 -
Book 6880, page 29.
3.
Topaz dedicated the street and storm easement on March l8,
1966 - Book 7317, page 113.
At this time, Valley still owns the one parcel including 185'
frontage on Hacienda and approximately 86' where we wanted
and thought we had the storm easement. Later this parcel was
reconveyed to Topaz and another parcel, similar to the first
andl75' wide, was deeded to Valley. A l75' x 35' exception
"as deeded to the City of Campbell" starts to appear on the
deeds.

valley dedicates 35' by l75' parcel that was mentioned in
previous deeds as the exception on August 5, 1969 - Book 8628,
page 357.
The Assessor's Office caught the errors in property ownership.
Valley now wants some action to dispose of any interest in
the subject property. Apparently this is their only interest,
and this deed is proper.
This land is now all owned by Eugene and Andre LeRoy. The City
still has not acquired the storm easement across the portion of
land that Valley owned when Topaz granted the easement to the City.
Likewise, because of the changes in the parcels, owners, etc., the
City is lacking a 10' x 35' parcel of roadway dedication. This
occurred because we missed the 185' on the Topaz dedicatio~ and
Valley dedicated their 175' leaving a 10' strip not dedicated and
belonging to the LeRoys.
To simplify dedications that must take place now, I suggest that
we rerecord the original Topaz dedication and easement grant, this
time under the name of the LeRoys. This action would insure the
City no further question as to the dedication and easement.

this afternoon.
In the early part of Dec~er, 1967, you reque8ted ,us to
energize-said electro11ers. I,then talked to Mr. HOward Dean,
of the Lo8 Gat08 Pacific Gas and Electric office,Who informed
me that' as far a8 he knew the only itemneces8ary 1;o:~ effect thi8
was for the City of, Campbell to request that the energ1zing be
by letter. On December 11," 1967, I requested the. system energized.
I have, this dat- received a call from Mr. Dean stating that
the system cannot be energized because the wiring for the system
has not been installed.
I would like to point out, for the record, 'that the City of
Campbell holds the property owners responsible ~or the in8talla-
tion or completion of this system, among other thing8, and 1t 1s
hereby requested that steps be taken to complete the 8Y8tem so
that the electrol1ers can be energ1zed.

BEING A RESOLUTION AUTHORIZING EXECUTION
OF TOPAZ BUILDERS, INC. AGREEMENT.
WHEREAS, there has been submitted to the City Council
by Topaz Builders, Inc. an agreement for the development
of their real property in accordance with prescribed conditions;
WHEREAS, by the terms of said agreement, and concurrently
herewith they have submitted grant deeds of certain
portions of their property for street purposes;
NOW, THEREFORE, BE IT RESOLVED by the City Council
that the Mayor be and he is hereby authorized to execute the
said agreement on behalf of said City; and
BE IT FURTHER RESOLVED that the grant deed submitted
in connection therewith be and the same is hereby accepted.

TOPAZ BUILDERS is hereby issued a Planned Development Pe~it
to construct a shopping center on property located at 1143 San Tomas
Aquino Road (northwest corner of intersection of San Tomas Aquino Read
and Hacienda) as per plans submitted for building permit, subject to the
following conditions:
1. Conformance to Section 9126 of the Campbell Municipal
Code, including:
a.
Dedication to 90' R/W on Hacienda Avenue and dedication to 90'
R/W, or such other lesser width as may be approved by the City
Council. on San Tomas Aquino Road.
Full street improvements on total frontage of Hacienda Avenue i
and San Tomas Aquino Road.

landscaping plan, specifying types of plants, when applying for

$2,500.00 to insure landscaping within three (3) months after comple-
tion of each phase of development.
6. Applicant to submit plans for buildings of Phases II,
III, and IV for architectural review prior to obtaining Building
Permits for these phases.
APPROVED by City Council Ordinance 1522 on the 13th
day of December 1965 to become effective on the 12th day of January,

BEING AN ORDINANCE AMENDIN [IE ZONING MAP
OF THE CITY OF CAMPBELL, AND SETTING FORTH
THE DEVELOPMENT SCHEDULE FOR PLANNED
DEVELOPMENT ZONE
The City Council of the City of Campbell does ordain as
follows:
SECTION ONE: That the Zoning Map of the City of Campbell,
being part of Chapter 3) Article IX of the Campbell Municipal Code
as referred to in the Appendix of said Code, together with amend-
ments thereto, is hereby changed and amended. Said amendment
being outlined on the attached map, entitled Exhibit A;

SECTION TWO: That the following attached Exhibit B,
entitled Development Schedule and Exhibit C entitled Plans and
Elevations, copies of which are on file in the Planning Department,
be adopted by reference and hereby made a part of the Planned
Development Zoning District, subject to the following conditions:
