Dear Mr. Bini:
We have reviewed the grading and drainage plan for Tract 6230,
adjacent to Page Ditch, which was hand delivered to us on May 18.
The proposed grading should divert surface drainage away from
Page Ditch and is therefore satisfactory.
The drainage of the site into the existing 30-inch storm sewer
should not be allowed as it would increase flows in Page Ditch
resulting in flooding at San Tomas Aquino Road.
As stated in our letter of November 16, 1977 to the City of
Campbell, pertaining to the improvement of Capri Drive and the
installation of the 30-inch storm drain, Page Ditch is only a
42-inch pipe from San Tomas Aquino Road to Smith Creek. The
installation of an additional 42-inch pipe down Westrnont Avenue
would provide the additional capacity needed, (about 30 cubic
feet per second).
No Santa Clara Valley Water District permit is needed for the
proposed work in this tract.

Dear Mr. Elliot:
We have reviewed the revised improvement plans for Capri Drive
and grading and drainage plans for the Lands of Detrick Corpor-
ation which were hand delivered to us on November 18, 1977.
Our records show that the existing creek at the proposed 30-inch
pipe outfall is about 2.5 feet which is considerably less than
shown on the plans. The comments in our letter of November 16,
(copy enclosed) still apply.
Please have Sheet 3 of 7 conform to Sheet 4 of 7 regarding the
size and connection of the 30-inch C.M.P. Also, on Sheet 4, the
detail showing the P.C.C. collar connection of the 3D-inch C.M.P.
to the 30-inch R.C.P. should be modified. Please show the al1g1e

anã the centerline of the 30-inch C.M.P. as shown on the enclosed
excerpt from Sheet 4.
In accordance with District Ordinance 75-6, the owner should show

Dear Mr. Hill:
The following list is for your convenience in rechecking the
referenced drawings:
1. Sheet 3 shows the storm drain 5' east of centerline Capri
but sheet 4 shows it 5' west of centerline.
2. The storm drain should fall to the north at a sloQe of
0.002 (or 0.2%). But sheet 3 shows the invert at the
northerly manhole (230.27) higher than at the southerly
manhole (230.14).
3. Sheet 3 cans for 41 IF of 1511 CMP from the last manhole
to the outfall but sheet 4 calls for 20 IF of 3011 RCP and
an unspecified length of 30" CMf> to the outfall.
4. Sheet 4 implies that the storm drain is at an angle of 50
from the centerline throughout Capri Drive but this would
produce an offset of 46.58 feet from the manbole at Hacienda.
5. The storm manhole at Hacienda is labeled sanitary manhole.
It shows a 27" RCP(in) but there is no 27" RCP coming in.
6. The profile of the ~O" stonn main in Capri on sheet 3
shows it running from the manhole in Hacienda to an inlet
at 5+92.46.
7. Show the pronosed centerline grade of Capri on sheet 3
profile.
8. There is no alreement as to size and kind of pipe and
location of the manhole and inlets at the northerly end
of the storm line in Capri.

We have some additional comments to those of our letter of
October 3, 1977, (copy enclosed), on the drainage plans for Lands
of Detrick Corporation, sent to us on September 8,1977.
According to the map prepared by your City showing storm drainage
areas contributing to Page Ditch, the proposed 30-inch outfall
would add about 85 acres to the watershed area of Page Ditch.
The resultant increase in flows in Page Ditch would result in
flooding at San Tomas Aquino Road. Page Ditch is only a 42-inch
pipe from San Tomas Aquino Road to Smith Creek. The installation
of an additional 42-inch pipe down Lovell Avenue would provide the
additional capacity needed (about 30 cubic feet per second).
The existing ditch at the proposed outfall is only about 2.5 feet
deep. To provide a suitable outfall for the proposed 30-inch pipe,
the ditch should be deepened and excavated to the existing 48-inch
pipe located to the west.
Please submit drainage modification plans for our review prior to
the start of any construction.

Dear Mr. Hill:
We have reviewed the preliminary plans for the improv~~ent of
Hacienda Avenue and Capri Drive and grading and drainage plans
for Lands of Detrick Corporation sent to us on September 8, 1977.
The storm drain details on sheet 3 do not agree with those on
sheet 4. R.C.P. cannot be allowed within the Page Ditch right
of way. C.M.P. is recommended. If portion outside of SCVWD right
of way is to be R.C.P., connect to C.M.P. using concrete collar
shown on the enclosed District sheet 10.
The proposed outfall alignment results in the outfall pointing
upstream which is not desirable. Show angle between proposed
outfall pipe and scmvD right of way.
The bank protection for the outfall should be designed in accord-
ance with the enclosed SCVWD sheet 9 and as marked on sheet 4
(enclosed) of the plans. Please dimension the sacked concrete
with respect to the centerline of pipe.
Refer to the enclosed marked sheets 3 and 4 for additional miscel-
laneous comments and corrections.
Please submit revised plans for our review and issuance of a permit
prior to construction.

THIS AGREE~ÆNT, (identified as No. Snks(35)) made and entered
into this day of , 19 , by and between
DETRICK CONSTUCTION CORP., a California corporatjon
hereinafter referred to as "Owners", and the CITY OF CAMPBELL, a
municipal corporation of the County of Santa Clara, State of Cal-
ifornia, hereinafter referred to as "City".
WITNESSETH:
WHEREAS, Owners did heretofore on November 12 , 19~,
apply to City for approva I in order to construct a shoppi nq center
that certain real property described
as Parcel "B", as said Parcel "B" is shown upon that certain Parcel Map
recorded Fp.brlJary 17 , 19 70 , and filed in Book 264 of
Maps at page 36 in the office of the County
Recorder of the County of Santa CTara, State of California, which
property is hereinafter referred to as "said real property";
WHEREAS, at its regular meeting held March 28 ,
19-11_, the City Council of City did consider said
application and grant its approval thereon subject to certain con-
ditions thereof as cont~ined in Ordinance No. 1071
NOW, THEREFORE, IT IS f 'UTUALLY AGREED TO by and between the
parties hereto as follows, ~o wit:
(1) It is agreed to that Owners are not required to
prepare and/or cause to be prepared a parcel map in accordance
with the provisions of the Subdivision Map Act of the State of
California, which map shall þe submitted to the City Engineer of
City for examination, approval and recordation within thirty (30)
days from the date hereof. It is further agreed to that if Owners
choose to, or are required to, .submit a parcel map, Owners shall
pay City the sum of SEVENTY-SIX-n_n__-__n_n____nn_n__n__n______-

tentative and final parcel map.
(2) It is further agreed to that Owners shall provide, con-
struct and/or install at their own proper cost and expense upon

FIRST: Provide and construct City of Campbell standard
curb and gutter, commercial sidewalk and driveway approaches, and
wheel chair ramp, consisting of Portland Cement Concrete, as shown
upon the improvement plans for said real property approved by
the City Engineer of City.
SECOND: Provide and construct City of Campbell standard
pavement structures consisting of untreated crushed rock base
course and asphaltic concrete surface course or approved
equivalent in accordance with said approved improvement plans.
THIRD: Provide and construct City of Campbell standard
storm water inlets, storm sewer manholes, storm sewer mains
and laterals as shown upon said improvement plans.
FOURTH: Grade said real property in accordance with
approved building plans.
FIFTH: Provide and install City of Campbell standard
street monument boxes, street name signs, regulatory signs
and sign posts therefor, barricades and redwood headerboards,
as shown upon said improvement plans.
SIXTH: Provide and install City of Campbell standard
street light steel poles, with upsweep bracket arms, luminaires,
with individual integral photoelectric cells, electrical under-
ground conduits with conductors and junction boxes, all as
shown upon said plans and as approved by said City Engineer.
SEVENTH: Provide and install or cause to be installed
a water distribution system, including fire hydrants and
appurtenances to serve said real property as shown upon said
plans.
EIGHTH: Provide and install a sanitary sewerage system
to serve said real property as shown upon said plans.
NINTH: Provide and install an underground electrical
energy system and an underground telephone system to serve
said real property.
TENTH: Provide and plant street trees of a variety and
size as shown upon the plans and as approved by said City
Engineer.

(3) It is further agreed to that Owners shall provide and
construct and/or install all of said public street improvements
when Owners are so notified to do so by said city Engineer of
City.
(4) It is further agreed to that all of said improvements
shall be constructed and/or installed within twelve (12) months
from the date that Owners are notified by said city Engineer to
do so; provided, however, that in the computation of said
twelve-month period, delays due to or caused by acts of God,
viz., unusually inclement weather, major strikes, other delays
beyond the control of Owners shall be excluded.

It is expressly understood and agreed to that if Owners
shall fail to complete the work required by this Agreement
within the said period of twelve (12) months, the City, after
giving ten (10) days written notice thereof to Owners, may
construct and/or install said improvements and recover the full
cost and expense thereof from Owners.
(5) It is further agreed to that Owners shall prepare or
cause to be prepared at their cost and exp~nse improvement
plans for the construction and/or installation of said public
street improvements, which plans shall be prepared by a civil
engineer licensed by the State of California, which plans shall
be submitted to City Engineer of City for his examination and
approval and which plans shall be submitted to City Engineer
when Owners are so notified by said City Engineer.
(6) It is further agreed to that the construction work
of the improvements embraced by this Agreement shall be done
in accordance with the Stardard Specifications of the Depart-
ment of Public Works, Division of Highways, State of California,
dated January, 1973, and in accordance with the Specifications
of the City of Campbell and Sanitation District No.4 of Santa
Clara County, where indicat d.
WHEREVER the word "State" or words "Division of Highways"
are mentioned in the State Specifications, it shall be consi-
dered as referring to the City of Campbell. Also, wherever the
"Director" or "Director of Public Works" is mentioned, it shall
be considered as referring to the City Engineer.
In case of conflict between thé State Specifications and
the Specifications of the City of Campbell and Sanitation
District No.4 of Santa Clara County, the Specifications of
the City of Campbell and Sanitation District No.4 of Santa
Clara County shall take precedence over and be used in lieu of
such conflicting portions.
(7) It is further agreed to that Owners shall deposit
with City, when called upon to do sO,- for office- examination
of improvement plans, field inspection of construction of
improvements and all necessary expenses incurred by City in
connection with said improvements and all necessary expenses,

incurred by City in connection with said real property the sum
of ONE THOUSAND FIVE HUNDRED EIGHTY-NINE---------------------
-------------------------------------------- DOLLARS ($1,589-).
(8) It is further agreed to that Owners shall file with
City, upon execution of this Agreement, a bond in the amount
of FORTY-FIVE THOUSAND FIVE HUNDRED-------------------------
DOLLARS ($45,500.00-~ to insure full and faithful performance
of the construction of all the aforementioned improvement work,
excluding sanitary sewers and water distribution system. Said
bond shall guarantee that Owners shall correct and defect which
may appear in said work within one (1) year from the date of
acceptance of the work by City and pay for any damage to other
work resulting from the construction thereof, as well as paying
the cost of all labor and materials involved. This bond shall
remain in full force and effect until one (1) year after date
of final acceptance of said improvements.
(9) It is further agreed to that City reserves the right
to revise storm drain design shown on approved improvement plans
provided Owners are given reasonable wpitten notice of City's
intention to make revisions. Reimbursement amount will be
adjusted by difference between revised storm design and pre-
sently approved storm design, in accordance with City of Campbell
Storm Fee Schedule. ' .
(10) It is further agreed to that when called upon by
City to do so, Owners will execute a petition for the format.ion
of any special assessment district created pursuant to any
special assessment act as provided in the Streets and Highways
Code of the State of California created for the purpose of
constructing and/or installing any or all of the putlic improve-
ments herein described.
(11) It is further agreed to that Owners shall prrtici-
pate in and become a part of any special assessment uistrict
as described in paragraph (10) of this Agreement.
It is expressly understood that any obligations of Owners
contained in this Agreement that are accomplished to the satis-
faction of said City Engineer by said special assessrlent dis-
trict shall be considered nu1l and void.
(12) It is further agreed to that Owners shall make such
deposits or file such bonds and enter into such agreement as
required by Sanitation District No.4 of Santa Clara County
to insure the installation of a sanitary sewerage system to
serve said real property, and that Owners shall file with City,
upon execution of this Agreerr,ent, a letter, from sa ict Sanitation
District No.4 of Santa Clara County stating that Owners have
made such deposits or filed such bonds and entered into such
agreements.

(13) It is further agreed to that Owners shall pay to
Pacific Gas and Electric Company any and all fees required
for installation of undergound wiring circuit to all electro-
liers within said real property, when Owners are notified by
either the City Engineer of Campbell or the Pacific Gas and
Electric Company that the said fees are due and payable.
(14) It is further agreed to that Owners shall make
such deposits or file such bonds and enter into such agreement
as required by San Jose Water Works when called upon to do
so to insure the installation of a water distribution system
to serve said real property, including fire hydrant.
(15) It is further agreed to that any easement and
right of way within or without said real property necessary
for the completion of the project shall be acquired by Owners
at their own cost and expense. It is provided, however, that
in the event eminent domain proceedings are required for the
purpose of securing said easement and right of way, Owners
shall deposit or cause to be deposited with City a sum covering
the reasonable market value of the land proposed to be taken
and to be included in said sum shall be a reasonable allowance
for severance damages, if any. It is further provided that
in addition thereto such sums as may be required for legal
fees and costs, engineering and other incidental costs shall
be deposited with City.
(16) It is further agreed to that Subdivider shall pay to
City, upon the execution of the agreement, the sum of THREE
HUNDRED NINETY DOLLARS ($390.00) for fire hydrant rental costs.
(17) It is further agreed to that Owners shall carry out
any and all negotiations with all interested parties and shall
perform or cause to be performed at their own costs and expense
and to the satisfaction of the City Engineer any and all work
required to abandon, remove, raise, lower, relocate and other-
wise modify irrigation line or lines within the boundary of
said real property.
(18) It is further agreed to that the storm drainage area
fee in connection with said real property and in conformance
with the requirements established by Section 20.16.060 of the
Campbell Municipal Code is in the amount of ONE THOUSAND
TWO HUNDRED THIRTY-THREE------------DOLLARS ($1,233.00------).
It is further agreed to that City shall reimburse
Owner the sum of ONE THOUSAND TWO HUNDRED FORTY-FOUR---------
---------------- ($1,244.00--) for storm drainage system con-
struction as called for on the improvement plans in conformance
with the requirements established by Section 20.16.060 of the
Campbell Municipal Code, which reimbursement shall be paid Owner
when City releases Owner from bonding for the construction of the
improvements specified herein.

It is further agreed to that City reserves the right to

provided Subdivider is given reasonable written notice of City's
intention to make revisions. Reimbursement amount will be
adjusted by any difference between revised storm design and
presently approved storm design, in accordance with City of
Campbell Storm Fee Schedule.
(19) It is further agreed to that OWners shall indemnify
and save harmless the City of Campbell, the City Council and
the City Engineer, and any and all other officers or employees
of City from any suits, claims or actions brought by any person
for or on account of any injuries or damages to persons or
property sustained or arising in the construction of the onsite
work due to any acts, omissions or negligence of Owners, their
officers, agents, employees or contractors.
(20) It is further agreed to that the above-named terms
and conditions shall bind the heirs, successors, administrators
or assigns of Owners.
(21) This instrument is and shall be considered to be an
instrument affecting the right, title, interest in or posses-
sion of the real property hereinabove described.
IN WITNESS WHEREOF, said City has caused its name to be
hereunto affixed by its Mayor and City Clerk, thereunto duly
authorized by resolution of the City Council, and said Owners
have hereunto caused their names to be affixed the day and

The City Council of the City of Campbell does ordain a follows
SECTION ONE: That the Zoning Map of the City of Campbell is hereby
changed and amended by adopting the attached "Exhibit A", entitled IIPlans
and E1evationsll, IIExhibit BII entitled IIDevelopment Schedulell and IIExhibit CII
entitled IIMap of said Propertyll, as per application of Kjartan O. Armann
to allow construction of a shopping center on property known as 655 West
Hacienda Avenue in a Planned Development Zone. Copies of said exhibits are
on file in the office of the Planning Department.
Said approval granted subject to the following conditions:
A. Property to be fenced and landscaped as indicated and as added in
IIredli on plans.
B. landscape plan indicating type of plant material, location of hose
bibs or sprinkler system and type of fencing to be submitted for approval of
the Planning Director at time of application for building permit.
C. landscaping shall be maintained in accordance with the approved
landscape plan.
D. Faithful performance bond in the amount of $5,000 to be posted to
insure landscaping, fencing and striping of parking area within (3) months
of cJmp1etion of construction, or applicant may file written agreement to
complete landscaping, fencing and striping of parking area prior to final
Building Department clearance.
~. All mechanical equipment located on roofs shall be screened as approved
by tne Planning Director.
F. All parking and driveway areas to be developed in compliance with
Section 21.50 of the Campbell Municipal Code. All parking spaces to be
provided with appropriate concrete curbs or bumper guards,
G. Underground utilities to be provided as required by Section 20.16.070
of the Can;pbe 11 Mun i c i pa 1 Code.
H. Plans ~ubmitted to the Building Department for plan check shall indicate
clearly the location of all connections for underground utilities including
water, sewer, electric, telephone and television cables, etc.
t. Sign application to be submitted in accordance with provisions of the
sign ordinance for all signs. No sign to be installed until application is
approved and permit issued by the Building Department.

J. Ordinance No. 782 of the Campbell Municipal Code stipulates that any
contract "for the collection and disposal of refuse, garbage, wet garbage
and rubbish produced within the limits of the City of Campbell shall be made
with Green Valley Disposal Company. This requirement applies to all single
family dwellings, multiple apartment units, to all commercial, business,
industrial, manufacturing, and construction establishments.
K. Trash container(s) of a size and quantity necessary to serve the
development shall be located in area(s) approved by the Fire Department.
Unless otherwise noted, enclosure(s) shall consist of a concrete floor
surrounded by a solid wall or fence and have self-closing doors of a size
specified by the Fire Department. All enclosures to be constructed at grade

L. Applicant shall meet all State requirements for the handicapped.
M.Any commercial use of the subject property shall be limited to those
uses allowed in the C-l, "!eiQhborhood Commercial District.

O. Enter into agreement and post bonds for public street improvements
throughout Capri Drive and Hacienda Avenue frontage.

At the City Council meeting of February 28, 1977, the Council requested
that staff provide additional traffic information relative to a proposed
commercial development at the northeast corner of Hacienda Avenue and
Capri Drive. A decision regarding approval of this project was deferred
to the meeting of March 14,1977 pending receipt of this additional
traffic information.
Attached is a memorandum dated March 8, 1977 from Mr. Helms, wherein
specific traffic matters are addressed. Staff will review this matter
during the meeting and will be available to answer any additional questions
members of the Council may have.

The proposed commercia] development on the northeast corner of
Hacienda Avenue and the extension of Capri Avenue consists of
14,650 sq. ft. of floor space. It is estimated that this
development will generate approximately 350 trips per day as a
neighborhood-oriented retail and service outlet. It is projected
that little, if any, patronage would be attracted from persons
not residing in the surrounding area or regularly using the
abutting streets. -
Hacienda Avenue carries approximately 10,000 cars per day
currently at this location, and the staff's projection is that
this volume will approximately double, ultimately. This projected
vJlume will be accommodated by a 4-lane arterial within a planned
90 foot right-of-way.
Th~ widening of Hacienda Avenue is being accomplished by the
requirement of dedication and street improvements construction by
the land developers as they improve their properties fronting
C'1to Hacienda Avenue. There are no plans by the County for any
t oadway construction work in the foreseeable future for either
~acienda Avenue or Capri Avenue; nor has the City staff recommended
any construction in these areas as a part of the proposed 6-year
capital improvement program recently reviewed with the City Council.
In summary, the staff's opinion is that the impact of the proposed
development on the existing and projected traffic flow conditions
at this location will not be significantly detrimental. The
vehicular and pedestrian movements would be monitored after the
start of operations to determine whether it would be necessary to
impose additional on-street restrictions to assure adequate s~fety
conditions.
