Hacienda Avenue ----..- -------------------------------------- -------- RE Cor"lM EN DA TI ON That the City Council approve the Planning Commission's Resolution No. 1936 subject to the attached conditions. DISCUSSION The applicant is proposing to construct a single-family dwelling on the rear portion of a 14,610 square foot parcel. In addition, the proposal indicates ~he removal of the existing garage and the replacement of this structure by a two-car garage behind the existing residence on the front portion of the property. The proposed dwelling consists of approximately 1,415 square feet of living area and an attached two-car garage. Building materials are indicated as textured masonite siding and composition shingles for roofing. The site plan indicates that approximately 62% of the lot would be 1 andscaped. The Architectural Advisor is of the opinion that the building design and site plan are generally acceptable. The Planning Commission is recommending approval of this project. The proposed structures are consistent with the R-l (Single-Family Residential) Zoning District which was the zoning of this parcel prior to the present Interim zoning. Under the prior R-l zoning, this item would not be considered by the Commission or the City Council. This item was heard by the Planning Commission at its regular meeting on September 16,1980, and recommended for approval by a 7-0-0 vote. ld CITY OF CAt1PBELL PLANNING COMMISSION RESOLUTION NO. 1936 After notification and public hearing as specified by law on the application of Mr. Alberto Veloz for a use permit and approval of plans and elevations to construct a single-family house on property known as 1159 W. Hacienda Avenue in an Interim (Low Density Residential) Zoning District, as per application filed in the Office of the Planning Department on August 20,1980, and after presentation by the Planning Director, proponents and opponents, the hearing was closed (UP 80-25). After due consideration of all evidence presented, the Commission did find as foll ows: That the establishment, maintenance, and operation of the proposed use will not be detrimental to the health, safety, peace, morals, comfort or general welfare of the persons residing or working in the neighborhood of such use, or be detrimental or injurious to the property and improvements in the neighborhood or the general welfare of the City. Based on the above findings, the Planning Commission does hereby grant the requested use permit subject to the following conditions: - 1. Property to be fenced and landscaped as indicated and/or added in red on plans. 2. Fencing plan indicating location' and design details of fencing to be submitted for approval of Planning Director prior to application for building permit. Landscaping and fencing shall be maintained in accordance with the approved plan. 3. The applicant is notified as part of this application that he/she is required to meet the following conditions in accordance with Ordinances of the City of Campbell and Laws of the State of California. A. All parking and driveway areas to be developed in compliance with Section 21.50 of the Campbell Municipal Code. All parking spaces to be provided with appropriate concrete curbs or bumper Qua rds. B. Underground utilities to be provided as required by Section 20.16.070 of the Campbell Municipal Code. Plans submitted to the Building Department for plan check shall in~icate clearly the location of all connections for underground utilities including water, sewer, electric, telephone and television cables, etc. C. . Resolution No. 1936 ( -2- \... UP 80-25 ~- D. Ordinance No. 782 of the Campbell Muncipal Code stipulates that any contract for the collection and disposal of refuse, garbage, wet garbage and rubbish produced within the limits of the City of Campbell shall be made with Green Valley Disposal Company. This requirement applies to all single-family dwellings, multiple apart- ment units, to all commercial, business, industrial, manufacturing and construction establishments. Eo Trash container(s) of a size and quantity necessary to serve the development shall be located in area(s) approved by the Fire Department. Unless otherwise noted, enclosure(s) shall consist of a concrete floor surrounded by a solid wall or fence and have self-closing doors of a size specified by the Fire Department. All enclosures to be constructed at grade level. F. Applicant shall comply with all appropriate State and City require- ments for the handicapped. G. Noise levels for the interior of residential units shall comply with minimum State (Title 25) and local standards as indicated in the Noise Element of the Campbell General Plan. FIRE DEPARTMENT H. Full area behind proposed addition to be left clear for turning radius of fire engines. PUBLIC WORKS DEPARTMENT 1. Pay the storm drainage area fee of $256. J. Dedicate right-of-way to 45 feet from the centerline of Hacienda Avenue. K. Obtain an excavation permit and post surety for any work in the public right-of-way. L. Construct street improvements on Hacienda Avenue frontage. The applicant is notified that he shall comply with all applicable Codes or Ordinances of the City of Campbell which pertain to this development and are not herein specified.
