RESOLUTION NO. 3648
BEING A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF CAMPBELL RECOMMENDING APPROV AL OF A SIGN
APPLICATION (PLN2005-16) TO ALLOW AN EXPRESSWAY
ORIENTED SIGN ON PROPERTY OWNED BY MR. SCOTT COOLEY
LOCATED AT 700 W. HAMILTON AVENUE IN A C-2-S (GENERAL
COMMERCIAL) ZONING DISTRICT. APPLICATION OF MR.
RICHARD BATTISTA, ON BEHALF OF THE PROFESSIONAL
CULINARY INSTITUTE. FILE NO.: PLN2005-16.
After notification and public hearing, as specified by law and after presentation by the
Community Development Director, proponents and opponents, the hearing was closed.
After due consideration of all evidence presented, the Planning Commission did find as follows
with respect to application PLN2005-16:
1. The proposed expressway-oriented sign is limited to identification of an on-site business
located on the project site.
2. The applicant has demonstrated that the business operation is dependent upon expressway
identification and that denial of said identification would cause an undue hardship.
3. The school is situated in a building with limited locations to place signage due to the building
design. The building design has significant glazing surfaces that limit the wall surface that
could accommodate a wall sign.
4. The applicant has demonstrated that the slgnage is similar to other similarly situated
businesses in the area.
5. The proposed expressway-oriented sign would best serve the public welfare and is necessary
to provide adequate visibility from San Tomas Expressway.
6. The height and sign area are the minimums necessary to provide adequate identification for
the business due to it location on the building and distance to the traveling public. The
building is situated 96 feet from the West Hamilton frontage and approximately 150 feet to
San Tomas Expressway.
7. The proposed sign, as conditioned, is architecturally compatible in design and consistent with
other building signage. The letter size is similar in style and size to the other building wall
sign identifying 'Gold's Gym'.
8. The proposed sign is architecturally compatible with the building in terms of color, style and
design and would be constructed of high quality durable materials. The provision of a
raceway to match the wall colors and the provision of individual channel letters presents a
sign that is less obstructive than a cabinet sign. Limiting the color of the sign letters to two
colors results in a simpler more refined appearance to the sign.

9. The project qualifies as Categorically Exempt project under Section 15311, Class 11 of the
California Environmental Quality Act (CEQA), pertaining to the construction of new on-
premIse SIgnS.
Based on the foregoing findings of fact, the Planning Commission further finds and concludes
that:
1. The proposed sign is consistent with the purposes of the Sign Ordinance by preserving and
improving the visual character of the community.
2. The proposed sign would not be detrimental to the public welfare or persons in the
neighborhood or the City as a whole and allows for reasonable business identification.
3. The proposed signs will promote the economic viability of the City by providing adequate
identification and visibility of the business, and will also best serve the public welfare and be
in keeping with the principles and purposes of the City's Sign Ordinance.
4. No substantial evidence has been presented from which a reasonable argument could be
made that shows that the project, as currently presented and subject to the required conditions
of approval, will have a significant adverse impact on the environment.
5. There is a reasonable relationship and a rough proportionality between the conditions of
approval and the impacts of the project.
NOW, THEREFORE, BE IT RESOLVED that the Planning Commission recommends approval
of a Sign Application (PLN2005-16) to allow an expressway oriented sign on property owned by
Mr. Scott Cooley located at 700 W. Hamilton Avenue in a C-2-S (General Commercial) Zoning
District.
Where approval by the Director of Community Development, City Engineer, Public Works
Director, City Attorney or Fire Department is required, that review shall be for compliance with
all applicable conditions of approval, adopted policies and guidelines, ordinances, laws and
regulations and accepted engineering practices for the item under review. Additionally, the
applicant is hereby notified that he/she is required to comply with all applicable Codes or
Ordinances of the City of Campbell and the State of California that pertain to this development
and are not herein specified.
COMMUNITY DEVELOPMENT DEPARTMENT
Plannine Division:
1. Approved Plans: Approval is granted for a Sign Exception (PLN2005-16) to an expressway
oriented sign located at 700 W. Hamilton Avenue. The sign design and location submitted
for building permits shall substantially conform to the project plans stamped as received by
the Planning Division on February 24, 2005. The permit allows the placement of an
individual channel letters reading 'Professional Culinary Institute' measuring 2 feet x 56 feet

and a three foot logo on a four-foot raceway.
2. Development Approval Expiration: The Sign approval shall be valid for one year from the
date of City Council approval. Within this one-year period a building permit must be issued
or the Sign Approval shall expire and be deemed void without further notification by the
City.
3. Sign Maintenance: The sign shall be maintained in good condition at all times and shall be
repaired as necessary.
Buildine Division:
4. Permits Required: A building permit application shall be required for the proposed sign.
The building permit shall include ElectricallPlumbinglMechanical fees when such work is
part of the permit. Prior to performing any work, the applicant shall make application to, and
receive from, the Building Division, all applicable construction permits.
