PC Res 3650 RESOLUTION NO. 3650 BEING A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CAMPBELL DENYING A MINOR MODIFICATION TO A SIDE YARD SETBACK (PLN2005-19) FOR AN ADDITION TO AN EXISTING SINGLE-FAMILY RESIDENCE ON PROPERTY OWNED BY DAVID AND PATTY SMITH LOCATED AT 901 N. CENTRAL AVENUE IN AN R-1-6 (SINGLE FAMILY RESIDENTIAL) ZONING DISTRICT. APPLICATION OF DAVID AND PATTY SMITH. FILE NO. PLN2005-19. After notification and public hearing, as specified by law and after presentation by the Community Development Director, proponents and opponents, the hearing was closed. After due consideration of all evidence presented, the Planning Commission did find as follows with respect to application PLN2005-19: 1. The proposed project is not consistent with the R-1-6 (Single-Family Residential, 6,000 square foot minimum lot size) Zoning District and development standards in that it does not meet the minimum side yard setback along the southern property line. 2. The subject property is currently developed with a single-story home with an attached one- car garage and a detached accessory structure. 3. The side yard setback requirement is the greater of five feet or one-half the height of the building wall adjacent to the property line. The proposed second story addition has a wall height of 19 feet, which requires a nine-foot, six-inch side yard setback. 4. The proposed project requests a minor modification to the southern side yard setback requirement to allow a six-foot side yard setback where nine-feet, six-inches are required. 5. The proposed project is not well designed and is not architecturally compatible with the surrounding neighborhood. 6. The subject property is located on the west side of North Central Avenue, between Payne and David Avenues. The property is surrounded on all sides by single-family residences. Based on the foregoing findings of fact, the Planning Commission further finds and concludes that: 1. The side setback would be detrimental to the health, safety, peace, comfort or general welfare of persons in the neighborhood, or the City as a whole. 2. The side setback would unreasonably interfere with the ability of adjoining property owners to enjoy access to air, privacy, sunlight, and the quiet enjoyment ofthe owner's property. NOW, THEREFORE, BE IT RESOLVED that the Planning Commission denies a Minor Modification to a Side Yard Setback (PLN2005-19) for an addition to an existing single-family residence on property owned by David and Patty Smith located at 901 N. Central Avenue in an R-1-6 (Single-Family Residential) Zoning District.
