BEING A RESOLUTION APPROVING RELEASE AND
TERMINATION OF AN AGREEMENT BETWEEN THE
CITY OF CAMPBELL AND FEDERATED DEPARTMENT
STORES, INC.
WHEREAS, a certain agreement dated April 10, 1972, and recorded April
18, 1972, in Book 9793 of Official Records, page 355, was entered into
by and between Federated Department Stores, Inc" referred to therein
as OWNERS, and the City of Campbell, a municipal corporation, referred
to therein as CITY, relative to construction of certain improvements as
the same pertains to lands as more particularly set forth and described
therein; and
WHEREAS, the owners, their successors or assigns have fulfilled all the
terms and provisions as contained in said agreement;
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of
Campbell does hereby release the owners as above set forth, their
heirs, successors, or assigns from all obI igations contained in said
agreement, and terminates said agreement,

BEING A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF CAMPBELL, COUNTY' OF SANTA CLARA, STATE
OF CALIFORNIA, ACCEPTING THE AGREEMENT OF
FEDERATED DEPARTMENT STORES, INC. FOR
DEVELOPMENT OF REAL PROPERTY LOCATED AT
600 EAST HAMILTON AVENUE AND AUTHORIZING
EXECUTION OF AGREEMENT.
WHEREAS, Federated Department Stores, Inc. have submitted an
agreement to this City Council for the development of their real
property delineated, shown and designated as Parcel A upon the
map recorded March 9, 1972, and filed in Book 298 of Maps at
Page 1 in the office of the County Recorder of said County of
Santa Clara in accordance with prescribed conditions; and,
NOW, THEREFORE, BE IT AND IT IS HEREBY RESOLVED by this City
Council that said agreement is hereby accepted and that the Mayor
be and he is hereby authorized and directed to execute said
agreement on behalf of the City of Campbell.

1.
Property to be fenced and landscaped as indicated and as added
in "redll on plans.
2.
Landscape plan indicating type of plant material, location of
hose' bibs or sprinkler system and type of fencinß to be submitted
for approval of the Planning Cbmmission at time of application for
building permit. All planter areas to be enclosed within 4'1 to
6" raised curbs.
3.
Landscaping shall be maintained in accordance with the approved
landscape plan.
4.
Faithful performance bond in the amount of $5,000 to be posted
to insure landscaping, fencing and striping of parking area within
three (3) months of completion of construction, or applicant may
file written agreement to complete landscaping, fencing and striping
of parking area prior to final building department clearance.
The applicant is notified as part of this application that he is
required to meet the following conditions in accordance with Ordinances
of the City of Campbell.
A.
All parking and driveway areas to be developed in compliance with
Section 9319 of the Campbell Municipal Code. All parking spaces
to be provided with appropriate curbs or bumper guards.
B.
Ónderground utilities to be provided as required by Section 9110.6
of the Campbell Municipal Code.
C.
Plans submitted to the building department for plan check shall
indicate clearly the location of all connections for underground
utilities including water, sewer, electric, telephone an¿ television
cables, etc.
D.
Sign application to be submitted in accordance with provisions ,of
the sign ordinance for all signs. No sign to be installed until
application is approved and permit issued by the building department.
E.
Complete automatic sprinkler system shall be provided.
F.
Payment of storm drainage area fee in the amount of $877,00.
G.
Revise building location to clear existin~ storm drainage and water
easements on easterly boundary or provide construction plans and
maintenance agreement satisfactory to the City Engineer and utility
company for an encrcachment per~it.
