Kee Planning Director Ci ty of Campbell 75 North Central Avenue Campbell, California 95008 Attention Martin Woodworth Planner I Dear Mr. Kee: We have reviewed the plot plan for a proposed building addition to Gerard Tire Company on Hamilton Avenue, adjacent to Los Gatos Creek, File S83-0l, sent to us on January 17. There is an old existing retaining wall in Los Gatos Creek adjacent to this site. The District does not believe this wall is stable and does not consider it as existing when determining the proposed District right of way. If there was no building on this site the requested District right of way would be com- puted using a theoretical 2:1 slope from the existing toe of the retaining wall plus 22 feet for a maintenance road. Since this right of way would in- clude some of the existing building, we would request right of way only over to the existing building. Therefore, concerning the proposed addItion, we would request that it not extend westerly of the existing building. The right of way could be in easement form, The portion of the proposed District right of way back from the existing top of bank, as shown on District topo maps, may be used for parking with the under- standing that the District would not be responsible for any damage to the parking area or anything parked on it due to bank failure, bank erosion or damage re- sulting from our maintenance activities. A guardrail should be installed between the parking area and the top of bank. This guardrail should be designed so that it could be easily removed in case the District needed to do any bank maintenance work. This District could accept no responsibility for repair or replacement of the guardrail due to bank failure or bank erosion or any other cause, AN AFFIRMATIVE ACTION EMPLOYER Mr. Arthur Kee -2- February 16, 1983 The top of bank shown on the applicant's map does not agree with District topo- graphic maps. There should be no fill placed on this site as it would add additional load on the retaining wall. There also should be no overbank drainage into the creek. See attached marked plan for detailed comments. The easement transfer should be arranged with Mr. Donald Lawrie of our Real Estate Division. In the event of failure of the existing wall (it has failed just upstream), the portion of the existing parking area within the unstable zone would be removed. Use of the unstable area for parking would require a written agreement that the owner (Gerard Tire Co.) agrees to hold the SCVWD not liable for any damage to the parking facilities due to creek bank failure or creek maintenance operations.
