Dear Mr. Wilson:
This letter is in response to your request concerning the City's acceptance of the public street
improvements constructed per the Agreement recorded January 25, 1974, in Book 0739 of
Official Records at Pages 566 through 575 in the Office of the County Recorder of Santa Clara
County, California.
A search of our records does not indicate a specific date of the City acceptance of the street
improvements on Hamilton Avenue and Llewellyn Avenue; however, occupancies of the
building would not have been granted if the street improvements had not been found
acceptable. Therefore, it is the City's position the improvements were found acceptable,
probably in 1975 or 1976.
The street improvements were not constructed upon the property described upon "Exhibit A."

BEING A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF CAMPBELL, COUNTY OF SANTA CLARA, STATE
OF CALIFORNIA, ACCEPTING THE AGREEMENT OF
ZIEGLER DEVELOPMENT CORPORATION FOR DEVELOPMENT
OF REAL PROPERTY LOCATED AT 550 \VEST HAMILTON
AVENUE AND AUTHORIZING EXECUTION OF AGREEMENT-
WHEREAS, Ziegler Development Corporation has submitted an
agreement to this City Council for the development of their real
property described upon that certain instrument recorded February
9, 1961, in book 5068 of Official Records at page 268 in the office
of the County Recorder of said County of Santa Clara in accordance
with prescribed conditions; and,
WHEREAS, in accordance with said prescribed conditions and
as specified and recited in the agreement and concurrently herewith
said Ziegler Development Corporation has submitted Grant Deeds
of certain portions of their real property for public street pur-
poses and related public uses (including public utility easements,
public service easements, public pedestrian easements, storm sewer
easements); and,
NOW, THEREFORE,' BE IT AND IT IS HEREBY RESOLVED by this City
Council that said agreement is hereby accepted and that the Mayor
be and he is hereby authorized and directed to execute said
agreement on behalf of the City of Campbell; and,
PASSED UPON AND ADOPTED this 14th day of January

five' 400 watt~ Mercury vapor, Schedule LB-2C electroliers on the
south side of Hamilton Avenue frca Llewellyn Avenue to 'the San
'ranas Expressway.
When installed, these ele<::troliers will be energized by the
contractor from a City-owned service point at the southeast corner
of Llewellyn and Hamilton Avenues.
Please assign electrolier numbers to these electroliers and

construction of the public street improvements required by the City of
Campbell on Hamilton Avenue, Llewellyn Avenue and the proposed leg of square
loop between Llewellyn Avenue and San Tomas Expressway.
Mr. Ziegler and I plan to be in the Campbell area May 30, 1973. It would be
helpful if we could have your comments by phone on the contents of this letter
so that we may conserve time when we get together again to discuss the project.
It is the agreement with which we are taking exception at this time. We need
your response as to the following items before we can accept the agreement in a
revised fom:
1. The paragraph reading fourth, insert "in accordance with approved building
plans" after the word property.
2. Paragraph two, we query the acceptability of submitting a bond by our
general contractor holding Ziegler Development Corporation and Johnson and Mape
Construction Company as responsible for construction of the off-site work along
Hamilton and Llewellyn Avenues. Subject bond would be written in favor of City of
Campbell. As indicated in the draft agreement, subject bond would be in the amount
of $42,800, and would remain in full force and effect until one year after the
date of final acceptance of said improvements by the City.
3. Paragraph 4 to be changed to indicate that the improvements plans have
already been prepared and only construction of the improvements are to be deferred
at this time.

4. Paragraph 5 - With the provision as indicated in the above item, it is
requested that the bond be delayed until building permit for the adjacent on-site
development is submitted to the City.
5. Paragraph 7 should be changed to indicate that the public street
improvements to be provided and the proposed leg of the square loop will occur when
grade separation by the county at the intersection of West Hamilton Avenue and San
Tomas Expressway does, in fact, occur. In view of this delay in timing, we must
have a present standard as the acceptable roadway to be constructed. AS it is our
understanding that an agreement exists between the county and city for construction
of the square loops, we request that the present 36' wide curb-to-curb roadway,
using a T.I. of 8, as indicated on the improvement plans for the half street of
Llewellyn, be acceptable for this proposed work and included as part of the agreement.
It should be further stipulated that if the grade separation does not occur by 1980,
this portion of the agreement, with reference to the leg of the square loop only,
become null and void.
In conjunction with this item, we request that the grant of deed for this
area, indicated as running between Llewellyn Avenue and San Tomas Expressway, not
occur until the proposed leg of square loop:is to be actually constructed. As
discussed with you, deferring the grant of 4eed will circumvent foreseeable problems
if the land were granted but the proposed construction and separation of grades were
never to occur. As owners of the ground, we would be in a position to dedicate and
provide a construction bond at that time for the work.
6. Paragraph 12 - It should be agreed that the City, after approval of plans, will
not arbitrarily revise any plan without reasonable written notice and an opportunity
by the owner to review the revision. Acceptability of the revision by the owner
would not be unreasonably withheld.
7. Paragraph 19 should be revised to indicate that the owners are responsible
only for the easement and right of way which affects the property for which this
agreement is being drawn. In the event that additional grounds are required, whether
by easement or by right of way, not wi thin the bounds of said real property for
purposes other than the improvement of said real property, that the City of Campbell
will, in fact, process those acquisitions.
8. Paragraph 20 indicates that this is a catch-all for the possibility of any
irrigation line or lines within the property, their relocation, abandonment, removal
or otherwise modification to save the City harmless. As discussed, we have no
knowledge nor are there any recorded easements concerning irrigation lines upon said
real property.
9. Paragraph 21 should work both ways; that the City of Campbell will save harm-
less the owner, its officers, employees or contractors from any injuries or damages
due to any acts, omissions or negligence of any employee or representative of the
City of Campbell performing their assigned tasks and duties.

We would like to point out that Exhibit A, as we understand it, consists of two
sketches titled "Land to be Granted to the City of Campbell" does not coincide with
the parcel maps prepared for us by Raymond Vail and Associates. The contact for
coordination is Mr. Earl Moore.
We would like to have this in a completely accurate form whether it is found that
the City of Campbell Engineer is accurate or Raymond Vail and Associates. For
example, one sheet indicates that 30' between the center line of Llewellyn and a
new property line is to be granted to the City. Our records indicate that the City
already holds 20' of subject 30'. Therefore, the land to be granted would consist
of a 10' strip along Llewellyn rather than 30'.
The grant deed affecting this dedication should thus be revised or reconfirmed.
