RESOLUTION NO.

RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF CAMPBELL MODIFYING THE SCHEDULE OF
FEES AND CHARGES
WHEREAS, the City of Campbell Financial Policies require an annual evaluation
of the Schedule of Fees and Charges to ensure that recovery of the cost of providing services is
recovered where appropriate; and
WHEREAS, there has been presented to the City Council of the City of Campbell
a Schedule of Fees and Charges for Fiscal Year 2004-05; and
WHEREAS, all of the required legal notices have been published pursuant to
Government Code; and
WHEREAS, the City Council of the City of Campbell hereby adopts the attached
modifications to the Schedule of Fees and Charges to be paid to the City of Campbell by all
persons desiring to obtain those items or services contained in the attached Fee Schedule
effective July 1, 2004;
BE IT FURTHER RESOLVED that this Resolution be made an addendum to the
City Council Policy Manual.

COMMUNITY CENTER BUILDING USE FEES
All fees and charges are based on room rental rates, administrative costs, utility costs,
preparation and set-up, staff supervision of event, and custodial clean-up. The fees and
charges set forth here are NOT negotiable.

Center Tenants for which there is no entry fee for
participation or attendance. Events sponsored by/for
Campbell High School Alumni groups are also included here.

(such as wedding receptions, anniversary or birthday parties,
cultural events, etc.) for which there are no entry fees for
participation or attendance, as well as fund-raisers or events

or other events where an entry fee is collected/charged or
funds are raised by or for business or commercial purposes

To qualify for resident rates, customers must provide proof of Campbell residency by showing
one of the following:
a) A valid California Drivers License with Campbell address;
b) Name and Campbell Address Imprinted on Personal or Business Check;
c) Recent Utility Bill with Customers Name and Campbell Address.
To qualify for non-profit rates, customers must provide a copy of their letter of non-profit
status from the California Secretary of State's Office with their non-profit ID number indicated
and pay with an organization check or charge card.

Decorating Time
All decorating time that is scheduled separate from the event time, will be
charged at Ih the above rates. EXAMPLE: If your reception is scheduled from
2:00 to 7:00 p.m., and you come in to decorate from 9:00 to 11:00 a.m., those
two hours of decorating time will be charged at 50 % of the applicable rate
stated above. (Group 3 Decorating time in Orchard City Hall = $50/hour;
Group 4 Decorating Time in Orchard City Hall = $75/hour).
PROCESSING FEES
1.
All applications are subject to a non-refundable $25 Processing
Fee. This fee is designed to cover administrative time required to
receive, process, and schedule your use as well as to refund your
deposit, when applicable, after your use.
2.
Any changes in time, date(s) or use made to a multi-use permit,
or made less than thirty (30) days prior to a one-time use, are
subject to an additional $25 Processing Fee. This additional fee
covers the staff time required to modify the scheduled use in the
software program, use calendars and staffing schedules
ADDITIONAL CHARGES
1.
Uses which extend beyond the approved reserved time will be
charged at 1 V2 times the normal rental rate.
2.
Uses which extend beyond 12:00 midnight will be charged at two
(2) times the normal rental rate.
3.
Reservations for recognized City holidays are subject to
additional fees to cover staff holiday pay (11/2 times the normal
rental rate), when staff can be obtained to take the assignment.

DEPOSITS (continued)
2. The City reserves the right to deduct from the damage deposit
additional charges relating to, but not limited to, janitorial services,
maintenance/repair services, staff supervisor's time, or emergency
services that were required as a result of customer's use.
3.
Deposits may be fully or partially withheld for any of the
following reasons:
a) Facility uses fees for time used in excess of that reserved.
b) Damage to the facility or equipment.
c) Misuse of the Community Center (Refer to Item F-3 in
Section V).
d) Inadequate clean-up by customer requiring additional
custodial time/services after customer's use.
4.
If additional fees due exceed the amount of deposit, customer will
be billed for the balance.
5.
Deposits, less any applicable additional charges, will be
processed through the City's Finance Department, approved by
the City Council, and returned to the customer by mail within 30
days of the date of last use.
6.
It is the customer's responsibility to keep the Campbell
Community Center office informed of any address or telephone
changes that may affect the prompt return of the customer's
deposit.

FACILITY USE WAIVER
Use of the facility for any purpose other than those specified in this Facility Use
Policy must be petitioned through written request to the Museum
Director/Historical Resources Supervisor. Such requests must outline intended
modifications or changes in detail demonstrating compliance with rules,
regulations and policy as stated above. Petitions for such FACILITY USE
WAIVER are subject to review by the Campbell City Council. The City
Council shall have the final authority to waive or modify rules or regulations.
Any and all requests/variances are considered individually, and are not
automatically applied as a matter of precedent to future similar uses.

NOTE: Clients shall reimburse the City for the cost of all required event staff and
technicians. Base rent fees are due 45 days in advance of the first use date. Equipment and
staffing fees will be deducted from the final settlement or deposit. The Theatre Manager
shall have the discretion to schedule staff s/he deems necessary to provide for a quality
production at the expense of the client. A staffing estimate shall be provided upon request
and at least a minimum of two weeks in advance of the event.
NOTE: Rehearsal times may be scheduled at the time the booking is made, but shall be
considered tentative until thirty (30) days prior to the first event date, and then will only be
scheduled when they do not inteifere with other scheduled events.

For events that are designed to be profitable, rental fees shall be ten percent (10%) of gross
ticket sales vs. the base rent (whichever is higher). Exceptions to this policy will be made for
Primary Partners and fund-raising events hosted by local non-profit organizations with ticket
prices greatly exceeding the normal market rates (i.e. $100 benefit performance tickets). In
those cases, the 10% shall be computed based on the market rate of the tickets, as determined
by the Theatre Manager.

Deposits:

A refundable security/damage deposit fee of $500 will be required to hold a date(s) on the
Theatre calendar. At the conclusion of the event, the deposit may be applied to (deducted
from) the total balance due if Theatre Manager has performed a full Theatre Use Evaluation
and there are no outstanding fees for damaged or lost equipment, or repairs to the facility. If
settlement is made prior to the evaluation, the deposit will be held until the evaluation is
performed and the deposit, less any necessary repair or equipment costs, will be returned to
the client within twenty working days.
b. Any fees paid less than thirty days in advance of the first use date must be paid by cash,
guaranteed money order, or a VISA/Mastercard in the name of the hosting/producing
organization/person.
