CC Resolution 10346 RESOLUTION NO. 10346 BEING A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CAMPBELL FINDING THE PROPOSED CAPITAL IMPROVEMENT PLAN 2004-2011 TO BE CONSISTENT WITH THE CITY'S GENERAL PLAN PURSUANT TO SECTION 65401 OF THE STATE OF CALIFORNIA GOVERNMENT CODE AND FINDING THE CIP PROJECTS TO BE CATEGORICALLY EXEMPT UNDER THE CALIFORNIA ENVIRONMENTAL QUALITY ACT (CEQA). After notification and public hearing, as specified by law, and after presentation by the Community Development Director, proponents and opponents, the hearing was closed. After due consideration of all evidence presented, the City Council did find as follows with respect to the 2004- 2011 Capital Improvement Plan (CIP): 1. The proposed 2004-2011 CIP is consistent with the City's General Plan and Redevelopment Plan, pursuant to Section 65401 of the State of California Government Code. 2. The CIP Projects are categorically exempt under CEQA and that these projects will not have a significant impact on the environment due to their location, cumulative impact or unusual circumstances. Based upon the foregoing findings of fact, the City Council further finds and concludes that: 1. The Capital Improvement Plan 2004-2011 is consistent with the General Plan. 2. No substantial evidence has been presented from which a reasonable argument could be made that the CIP projects would have a significant adverse impact on the environment. NOW, THEREFORE, BE IT RESOLVED that the City Council finds the proposed Capital Improvement Plan to be consistent with the City's General Plan pursuant to Section 65401 of the State of California Government Code and finds the CIP projects to be Categorically Exempt.
