RESOLUTION NO. 10376
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CAMPBELL
AWARDING THE CONTRACT FOR PROJECT 03-05 COLLECTOR STREET
OVERLAYS, INCLUDING ADDITIVE ALTERNATES A1, A2, A3, AND AS;
AUTHORIZING THE PUBLIC WORKS DIRECTOR, OR HIS DESIGNEE TO
EXECUTE THE CONTRACT, APPROVING A 15% CONSTRUCTION
CONTINGENCY; AND EXECUTING CONTRACT CHANGE ORDERS
WHEREAS, bids were received by the City Clerk for construction of Project 03-05,
Collector Street Overlays, on July 27,2004; and
WHEREAS, O'Grady Paving, Inc. has been found to be the lowest responsible bidder
with a total base bid of$739,566.28; and
WHEREAS, funds for the resurfacing of McGlincy Lane were approved in the FY 04/05
Capital Improvement Program, Project 05-02; and
WHEREAS, West Valley Sanitation District, Santa Clara Valley Water District, San Jose
Water Company, and SBC have agreed to reimburse the City for the costs associated with
additive alternate bid items AI, A2, A3, and A5 in an estimated amount of $50,140 for work
associated with adjusting their respective utility covers to grade;
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Campbell
hereby awards the construction contract for Project 03-05, Collector Street Overlays to O'Grady
Paving, Inc.; authorizes the Public Works Director, or his designee, to execute the contract in the
amount of $783,166.28 encumber $117,474.94 as a 15% construction contingency, for a total
amount of $900,641.22; authorizes the Public Works Director, or his designee, to execute
contract change orders up to and within the 15% contingency, and approves the attached budget
adjustment.
