A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CAMPBELL
SUMMARILY V ACA TING A PUBLIC SERVICE EASEMENT AT
810 OLD ORCHARD ROAD AND AUTHORIZING
THE ACTING PUBLIC WORKS DIRECTOR TO SIGN A QUITCLAIM DEED
WHEREAS, on December 9, 2002 the City Council adopted Resolution 10135 vacating
excess public street right of way for property on Robin Lane east of Old Orchard Road; and
WHEREAS, a public service easement (PSE #2) fifteen feet in width was reserved for
public utility purposes, Document #16929309 recorded April 3, 2003; and
WHEREAS, the public service easement (PSE #2) is no longer necessary; and
WHEREAS, the vacation is to be made pursuant to Chapter 4, Summary Vacation, of
Part 3 of Division 9 of the California Streets and Highways Code; and
WHEREAS, a legal description and plat depicting the easement to be vacated is correctly
described in Exhibit A.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Campbell
does hereby vacate the public service easement (PSE #2) at 810 Old Orchard Road (APN 404-
29-047), authorizes the Acting Public Works Director to execute the necessary documents for the
vacation of this easement, and authorizes the City Clerk to record this resolution.

Also, excepting therefrom a Public Service Easement 15.0 feet in width; which is parallel
to and 7.5 feet distant northwesterly from the centerline of Robin Lane (60 feet wide)
and extends northeasterly from the northeasterly boundary line of Old Orchard Road to
the northeasterly boundary line of Tract No. 361, which is also the common boundary
line of said tract with San Tomas Expressway; as said Old Orchard Road and
northeasterly boundary line are shown of the final map of Tract No. 361, filed for record
in Book 12 of Maps at pages 12 & 13, Santa Clara County Records; and described as
follows:
A strip of land of the uniform width of 15.0 feet, lying equally on either side of a line
which begins at a point in the northeasterly line of said Old Orchard Road, distant
thereon, 15.0 feet northeasterly form the point of intersection of said northeasterly line
with said centerline of Robin Lane; thence from said point of beginning, N 77° 31' 40" E,
and parallel with said centerline, 120.0 feet to a point in said northeasterly boundary line
of Tract No. 361, from which the southeast corner of Lot 41 of said Tract No. 361 bears
N 12° 28' 20" E 15.0 feet
