RESOLUTION NO. 10504
BEING A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CAMPBELL FINDING THE PROPOSED CAPITAL IMPROVEMENT PLAN
2005-2012 TO BE CONSISTENT WITH THE CITY'S GENERAL PLAN
PURSUANT TO SECTION 65401 OF THE STATE OF CALIFORNIA
GOVERNMENT CODE AND FINDING THE CIP PROJECTS TO BE
CA TEGORICALL Y EXEMPT UNDER CEQA OR AL TERNA TIVEL Y A
NEGATIVE DECLARATION BE GRANTED.
After due consideration of all evidence presented, the City Council did find as follows with respect to
the 2005/2012 CIP:
1. The proposed Capital Improvement Plan 2005-2012 is consistent with the City's General Plan and
Redevelopment Plan, pursuant to Section 65401 of the State of California Government Code.
2. That the City Council finds the CIP Projects, with the exception of the Well Extraction Project, to
be Categorically Exempt under CEQA and that these projects will not have a significant effect on
the environment due to their location, cumulative impact or unusual circumstances.
3. That the City Council grants a Negative Declaration for the Well Extraction Project.
Based upon the foregoing findings of fact, the City Council further finds and concludes that:
1. The Capital Improvement Plan 2005-2012 is consistent with the General Plan.
2. No substantial evidence has been presented from which a reasonable argument could be made that
the CIP projects would have a significant adverse impact on the environment.
NOW, THEREFORE, BE IT RESOLVED that the City Council finds the proposed Capital
Improvement Plan to be consistent with the City's General Plan pursuant to Section 65401 of the State
of California Government Code and finds the CIP projects to be Categorically Exempt and hereby
grants a Negative Declaration for the Well Extraction Project.
